WHEATLAND CUSTOM HOMES,
INC.,
STIPULATION AGAINST LIENS
WHEREAS, LAWRENCE A. TUKIS and DEBRA C. TUKIS, of Cumberland
County, Pennsylvania, is about to execute contemporaneously herewith, a contract with
WHEATLAND CUSTOM HOMES, INC. of Lancaster County, Pennsylvania, for the erection of
a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract of land, situate in the Township of Monroe, County
of Cumberland, and Commonwealth of Pennsylvania, being mom particularlybounded and described
as follows, to wit:
BEGINNING at a point on the eastern right-of-way line of Lucinda Lane at the
dividing line between Lot No. 22A and Lot No. 22B as shown on the hereinafter mentioned plan of
lots; thence along said right-of~way line North 12 degrees 56 minutes 17 seconds West, a distance
of 230.19 feet to a point at the dividing line between Lot No. 1 lB and Lot No. 22A; thence along
said dividing line North 77 degrees 03 minutes 43 seconds East, a distance of 146.38 feet to a point;
thence continuing North 71 degrees 27 minutes 49 seconds East, a distance of 186.20 feet to a point;
thence South 09 degrees 05 minutes 30 seconds East, a distance of 248.92 feet to a point at the
dividing line between Lot No. 22A and Lot No. 22B; thence along said dividing line South 77
degrees 03 minutes 43 seconds East, a distance of 314.99 feet to a point, said point being the Place
of BEGINNING.
BEING Lot No. 22A on Subdivision Plan of Duffield Crossing for Lots 1 IA, 1 lB,
22A, 22B, 29A and 29B recorded in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania in Plan Book 87, Page 26.
UNDER AND SUB,IECT to Declaration of Restrictive Covenants recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Miscellaneous
Book 683, Page 461 and Amended and Restated Declaration as set forth in Miscellaneous Book
696, Page 4280.
UNDER AND SUBJECT to setbacks, easements, rights-of-way, conditions and
restrictions as shown on the above plan of record.
UNDER AND SUBJECT to a 25 foot wide drainage easement along the rear lot line
as shown on the above referenced Plan.
NOW, the day of September, 2003, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said
LAWRENCE A. TUKIS and DEBRA C. TUKIS, to the said WHEATLAND CUSTOM HOMES,
INC, to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with WHEATLAND CUSTOM HOMES, INC. and the further
consideration of One Dollar, to WHEATLAND CUSTOM HOMES, INC. paid by LAWRENCE
A, TUKIS and DEBRA C. TUKIS, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person
for any labor, or materi~ds purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
