For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for
the use of the surviving spouse is three (3) percent [72 P .S. 99116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is
zero (0) percent [72 P.S. 99116 (a) (1.1) (ii)). The statute does not exempt a transfer to a surviving spouse from tax, and the statutory
requirements for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
.e tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for
use of a natural parent, an adoptive parent, or a stepparent of the child is zero (0) percent [72 P .S. 99116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half
(4.5) percent, except as noted in 72 P.S. 99116(1.2) [72 P.S. 99116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. 99116(a)(1.3)]. A sibling
is defined, under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

In Re: Estate of Ted R. Shover
Dear Steve:
Enclosed are the Estate Valuations for Ted R. Shover.
.
With respect to account #360-00262, we can establish a marital tmst account for Ted
Shover's 50% tenants-in-common ownership ofthe assets contained therein. We will
also need to open a single account for Kathryn M. Shover to hold her 50% share of these
assets.
With regard to Ted Shover's IRA (account #360-70605), Kathryn Shover is the
beneficiary. She must open an IRA of her own in order to receive the assets from Ted
Shover's IRA. We should meet with her to discuss her payout options and other related
matters. Ted Shover did satisfY the minimum required distribution for the year 2000.
As for the Pennsylvania IM-IT Insured Municipals Income Tmst, the estate valuation
lists the date of death value for the 20 units (Series 83) held at Legg Mason. The date of
death value for the 134 units (Series 97) not held at Legg Mason is $23,569.26.
Finally, the name, address and phone number of the transfer agent for Adams County
National Banle Register & Transfer Co., 10 Commerce Dr',iNJ, 07016, 800-368-5948.
Please call to arrange a meeting. We will wait to hear from ru'

In Re: Estate of Ted R. Shover
Dear Steve:
Enclosed are the Estate Valuations for Ted R. Shover.
.
With respect to account #360-00262, we can establish a marital trust account for Ted
Shover's 50% tenants-in-common ownership ofthe assets contained therein. We will
also need to open a single account for Kathryn M. Shover to hold her 50% share ofthese
As for the Pennsylvania 1M-IT Insured Municipals Income Trust, the estate valuation
lists the date of death value for the 20 units (Series 83) held at Legg Mason. The date of
death value for the 134 units (Series 97) not held at Legg Mason is $23,569.26.
Finally, the name, address and phone number of the transfer agent for Adams County
National Barue Register & Transfer Co., 10 Commerce Dr., NJ, 07016,800-368-5948.

person of all generations, with the relationship of parent and child at each generation. At the
present time I have two children, as aforesaid.
1.03. Description of Expenses and Debts. I direct the payment of my just
debts and funeral expenses as soon after my death as may be convenient.
ARTICLE 2
DISPOSITION OF TANGIBLE PERSONAL PROPERTY
2.01. Personal Effects. All of my personal effects, jewelry, clothing,
household furniture and furnishings, books, personal automobiles, boats, and other such tangible
personal property owned by me at the time of my death, together with any insurance policies on
the property, I give to my Spouse if she survives me. If my said Spouse does not survive me, I
give the said tangible personal property to my children who survive me, to be divided among them
in any manner to which they agree, and if they do not agree, then in substantially equal (in value as
determined for estate tax purposes) shares as may be determined by my Executor. If my Spouse
does not survive me and none of my children survive me, this bequest shall fail, and the property
shall pass as part of the residue of my estate.
ARTICLE 3
RESIDUE. SURVIVAL OF SPOUSE
3.01. Disposition of Residue. If my Spouse survives me, I give all the rest of
the assets that I may own at the time of my death (including any property over which I may have a
power of appointment) to be divided between my Spouse and the trust described below which is
referred to in this Will as the "Residuary Trust." This Article 3 shall only apply if my Spouse shall
survive me, as the term "survive" is defined in this Will.
3.02. Marital Bequest to Spouse. I give outright to my Spouse assets from
my estate equal in value to an amount which, when added to the final estate tax values of all other
property interests includable in my gross estate for federal estate tax purposes which pass or have
passed to my Spouse under other provisions of this Will or otherwise and qualify for the marital
deduction, will entitle my estate to the minimum federal estate tax marital deduction necessary to
reduce my taxable estate to an amount on which no federal estate tax is due and the federal unified
credit available to my estate is fully utilized.
3.03. Selection and Valuation of Assets. The marital bequest amount shall
be satisfied in cash or in kind, or partly in each, with assets selected by my Executor from those
that are includable in my gross estate and that qualify for the marital deduction for federal estate tax
purposes. The assets so allocated in kind shall be considered to satisfy the marital bequest amount
on the basis of their value at the date or dates of distribution to my spouse.
3.04. Assets Excluded. My Executor is directed not to allocate to my spouse
any assets with respect to which the federal foreign death tax credit is available to my estate or any

shares of stock that would otherwise qualify for redemption under Section 303 of the Internal
Revenue Code.
3.05. Conformity With Internal Revenue. Code. It is my intent that the
marital bequest shall qualify for the marital deduction for federal estate tax purposes, and that the
provisions of this Will relating to the marital deduction shall comply with Section 2056 of the
Internal Revenue Code, or any similar successor provision. The provisions of this Will shall be
construed to conform to my intent and, to the extent that any provision cannot be so construed, it
shall be deemed void. Neither my Executor nor the Trustee shall take any action or have any
power that will impair the marital deduction, and all provisions of this Will regarding the marital
bequest shall be interpreted to conform to that objective. The terms "gross estate," "marital
deduction," and "interests in property which pass or have passed," as used in this Will, shall have
the same meanings as they have under Section 2056 of the Internal Revenue Code, or any similar
successor provision.
3.06. Election of Valuation. No provision of this Will shall be construed so as
to limit the discretion of the person required to fIle a federal estate tax return on behalf of my estate
to make, where allowable, an election for federal estate tax purposes to value my estate as of the
date of my death, or pursuant to the alternate valuation method provided for by the Internal
Revenue Code, or any other valuation provision of the Internal Revenue Code, provided that the
valuation method or the use of the valuation provision is allowable in determining the marital
deduction for federal estate tax purposes.
3. 07. Simultaneous Death. If my Spouse and I should die simultaneously, or
under such circumstances as to render it difficult or impossible to determine who predeceased the
other, my Spouse shall be conclusively presumed to have survived me for the purposes of the
marital deduction.
3.08. Residuary Trust. The balance of the residue of my estate I give to the
Trustee named in this Will, to be held as the "Residuary Trust."
3.09. Administration. The Residuary Trust shall be held, administered, and
distributed by the Trustee in accordance with the provisions of Articles 5 through 7 of this Will.
ARTICLE 4

Volume 24, Page 107, or the remaining portions of said real estate which have not been conveyed
to others or gifted to my son or my son and his spouse at the time of my death.

Shover by deed of George H. Myers, Jr. and Barbara A. Myers dated April 16, 1991 in
Cumberland County Deed Book "c" Volume 35, Page 63, or the remaining portions of said real
estate which have been conveyed to others or gifted at the time of my death.
(c) If my Spouse does not survive me and there is any unpaid (and
unreleased by gift) balance due and owing on any mortgage from a child and/or a child's spouse to
me then I specifically give and bequeath to such child and/or their spouse, or their issue if both
such child and their spouse have predeceased me, the entire unpaid and unreleased balance of any
and all such mortgages, including accrued interest to the date of my death.
(d) If my Spouse does not survive me, but I am survived by a child or
children, or issue of any child, then all of the rest of the assets that I may own at the time of my
death (including any property over which I may have a power of appointment), I give, devise and
bequeath, in equal shares, per stirpes and not per capita, unto such of my children as shall survive
me, but should any of them fail to survive me then the share such deceased child of mine would
have received shall pass to such of his or her issue as shall survive me, per stirpes, and if there be
no such issue the same shall lapse and be added to the remaining share or shares, provided that if
any beneficiary under this Section 4.01(c) shall be less than 21 years of age his or her share shall
be held in trust pursuant to Section 5.02(a) of this Will.

to or apply for the benefit of my Spouse during her lifetime all of the net income of the Residuary
Trust in montWy or in other convenient installments, but in no event less often than annually. If at

beneficiary's trust. It is my intention by this paragraph to establish a separate trust account for
each such beneficiary who is less than 21 years of age.

payments out of the principal to any beneficiary shall be conclusive on all persons interested in the
trust.
5.04. Incapacity of Beneficiary. If at any time any beneficiary entitled to
