1. Plaintiff herein is Groff Tractor & Equipment, Inc., a Pennsylvania business with a
principal place of business located at 6779 Carlisle Pike, Mechanicsburg,
Pennsylvania 17050.
2. Defendant herein is JCM, Inc. a Pennsylvania business with a principal place of
business located at 430 Candlewyck Road, Camp Hill, Pennsylvania 17011.
3. On or about July 26, 2006, Plaintiff entered into a rental agreement with Plaintiff
whereby Plaintiff rented to Defendant a Takeuchi TL 140 and a Takeuchi TL 150,
"mini" excavator, which are both pieces of heavy machinery which are typically used
in the construction business. Defendant returned both rental items damaged and
further has failed to pay for the rentals. A true and correct copy of the rental
agreement setting froth the terms and conditions aze attached hereto and incorporated
herein by reference as though set forth at length and marked collectively as Exhibit
«A»
4. Pursuant to the terms of the rental agreement, Defendant is responsible for any
damage caused while renting the equipment.
5. As set forth in the attached invoices, Defendant owes Plaintiff the sum of $13,539.32.
6. Plaintiff has made demand upon Defendant to pay the balance due; however,
Defendant has failed and otherwise refused to pay the balance due.
7. Statements issued to Defendant for the rentals and repairs to rental units total
$13,539.32. A true and correct copy of all statements issued are attached hereto and
incorporated herein as though set forth at length and mazked collectively as Exhibit
«B~,
8. Defendant's failure to pay the $13,539.32 is a material breach of the parties' rental
agreement.
9. As a result of Defendant's failure to pay the $13,539.32 Plaintiff has suffered
damages in the like amount, together with interest, attorney fees and costs.
WHEREFORE, Plaintiff, Groff Tractor and Equipment Company, Inc., demands
judgment in its favor and against Defendant, JCM, Inc. in the amount of $13, 539.32 together
with interest, attorney fees and costs .

Equipmait o leased. Should the Equ~tmtnt be used for bnger periods than
the term specified em page 1 of this Agreement, overtime shall be paid by
Customer to Groff at the daily rata.

7. Uses of Rauip~. Customer agrees that the equipment shall be used

and under its control, end that said Rquipmant will be epcrated by competent
emplayera of Customer. Customer is familiar wilt the proper opa'ation and
use of meats iter» of Equipment. Custarter aelprawkdgos that the Egeripmerit

Customer makes a claim, in writing, to Groff within three (3) days after

21. Credit Accounts. In the avast that Equipment is paid pursuant w a

Groff to cherge art amounts, including rpcal amounts, overtime charges and
service chatP,es, to said Case Acxottnt and Cuatamer agree w pay all charges
accoMing to the terms and conditions of the Credit Agretrrrtont and this Rent-I
ARreemcnt.
