Heretofore, the Defendant(s) opened a account with Plaintiff being Account No. 4352376720371590, for the purchase of good and services. 4. The Defendant(s) has/have made or authorized a number of purchases and as of July 10, 2007, Defendant(s) owes $3,071.01 on said account plus interest. 5. .Plaintiff maintains accurate books of account recording all credits and debits for PA OS Civil Cmplt Crdt Crd P&F File No. 2050.16978 this account. 6. .The Defendant(s) have/has received monthly billing statements from Plaintiff setting forth the nature and amount of all chazges made by Defendant(s), and the transactions between Plaintiff and Defendant(s) give rise to an account stated, upon which Plaintiff has relied. 7. The Defendant(s) made payments, but have/has refused to pay, and now refuses to pay the balance due and owing on the aforesaid account in the sum of $3,071.01, plus interest and costs. 8. By failing to object or dispute to the statements including the statement attached hereto as Plaintiffs Exhibit "A", Defendant(s) have/has assented to and agreed to the correctness of the balance due on the credit cazd account so as to constitute and account stated. 9. Despite repeated demands, Defendant(s) have/has failed to make the required installment payments when due and therefore the full amount of the account is now due and payable. Powers, by and through his attorneys, Summers, McDonnell, Hudock, Guthrie & Skeel, P.C., and Kevin D. Rauch, Esquire, and files the following Motion to Compel Answers to Supplemental Interrogatories and in support thereof avers the following: 1. This matter arises out of a motor vehicle accident which occurred on August 23, 2005. 2. As a result of this accident, the Plaintiff filed a Complaint sounding in negligence. 3. On August 27, 2009, Defendant served Plaintiff with Supplemental Interrogatories relative to the above-referenced matter. (A true and correct copy of correspondence between the parties dated August 27, 2009, is attached hereto as Exhibit "A".) 4. In accordance with Pennsylvania Rule of Civil Procedure 4009, Plaintiff's Answers to Defendant's Supplemental Interrogatories should have been received by September 28, 2009. 5. On November 2, 2009, Defendant's counsel forwarded correspondence to Plaintiffs counsel requesting that he respond to the outstanding discovery. (A true and correct copy of correspondence between the parties dated November 2, 2009, is attached hereto as Exhibit "B".) 6. To date, Defendant has not received any response from Plaintiff or Plaintiffs counsel regarding Defendant's Supplemental Interrogatories or the correspondence enumerated above. 7. It is necessary for proper defense of this lawsuit that Plaintiff file full and complete Answers to Supplemental Interrogatories. 8. Accordingly, pursuant to Pennsylvania Rule of Civil Procedure 4019, Defendant respectfully requests this Honorable Court to enter an Order directing Plaintiff to provide Defendant with full and complete Answers to Supplemental Interrogatories within twenty (20) days or suffer additional sanctions. 9. Counsel for Defendant certifies that he has attempted contact with Plaintiffs counsel in an effort to resolve this discovery dispute as set forth above. Despite such attempts by Defendant's counsel, however, Plaintiffs Answers to Supplemental Interrogatories have not been received by Defendant's counsel. 10. The Honorable Judge Hess has ruled upon a prior Motion to Compel in this matter. 11. Opposing counsel does not concur in this Motion. WHEREFORE, Defendant, William J.
