D'ALESSANDRO, individually and d/b/a COYOTE JOE'5 CAFE, and JOSEPH PATSY, individually and d/b/a COYOTE JOE'S CAFE Defendants IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA N0.07 - Sb 7/ CIVII, TERM COMPLAINT AND NOW, comes the Plaintiff, John Gross & Company, by and through its attorneys, MARTSON DEARDORFF WILLIAMS OTTO GILROY & FALLER, and hereby avers the following: 1. Plaintiff, John Gross & Company, is a food service distributor with a business address at 400 Cheryl Avenue, P.O. Box 1189, Mechanicsburg, Cumberland County, Pennsylvania,17055. 2. Defendant Coyote Joe's LLC d/b/a Coyote Joe's Cafe is a business corporation with a registered office address of 3401 Hartzdale Drive, Camp Hill, Cumberland County, Pennsylvania 17011 ("Defendant Coyote Joe's"). 3. Defendant Anthony T. D'Alessandro is an individual with an address of 53 Summer Drive, Dillsburg, York County, Pennsylvania 17019 ("Defendant D'Alessandro"). 4. It is believed, and therefore averred, that Defendant D'Alessandro is the fictitious owner of Coyote Joe's Cafe and, during all relevant times, did business as Coyote Joe's Cafe. 5. Defendant Joseph Patsy is an individual with an address of 53 Summer Drive, Dillsburg, York County, Pennsylvania 17019 ("Defendant Patsy"). 6. It is believed, and therefore averred, that Defendant Patsy is the fictitious owner of Coyote Joe's Cafe. COUNT I- BREACH OF CONTRACT 7. Plaintiff hereby incorporates paragraphs 1 through 4 as though fully set forth. 8. Plaintiff and Defendants began a course of dealings in which Plaintiff would deliver food service items to Defendants at their business location. 9. Defendants have refused and otherwise failed to make any payment of the invoices for food service items it received from Plaintiff from March 2007 through Apri12007. A true and correct copy of the invoice is attached hereto as Exhibit "A". 10. Defendants made no other attempts at payment or actual payment for the goods received. 11. Defendants have breached their contractual duty to make payment for the goods received. 12. As a direct and proximate result of Defendants' breach, Plaintiff has suffered an economic loss of $3,895.13. WHEREFORE, based on the foregoing, Plaintiffrespectfully demands judgment in its favor in the amount of $3,895.13, together with interest at 18% per annum, costs, attorney fees, and any other remedy this Court may deem appropriate. COUNT II- QUANTUM MERUIT 13. Plaintiff hereby incorporates paragraphs 1 through 12 as though fully set forth. 14. Based upon the above, Defendants are liable tothe Plaintiffand/or have been unjustly enriched in excess of $3,895.13. WHEREFORE, based on the foregoing, Plaintiffrespectfully demands judgment in its favor in the amount of not less than $3,895.13,. together with interest at 18% per annum, costs, attorney's fees and any other remedy this Court may deem appropriate. COUNT III -BREACH OF CONTRACT 15. Plaintiff hereby incorporates by reference the averments contained in paragraphs 1 through 12 as if fully set forth. 16. Defendant D'Alessandro executed a personal guarantee of payment of Defendant Coyote Joe's. A true and correct copy of the personal guarantee of payment is attached hereto as Exhibit "B." 17. Defendant D'Alessandro is in breach of the agreement to pay Plaintiffin the amount of $3,895.13. 18. Pursuant to the personal guarantee, Defendant D'Alessandro is liable for the amount owed by Defendant Coyote Joe's and has failed to pay the same. WHEREFORE, Plaintiff demands judgment against Defendant D'Alessandro in the total amount of $3,895.13, plus interest at 18% per annum, costs, attorney's fees and any other remedy this Court may deem appropriate.
