COMPLAINT
1. Plaintiff, CHASE BANK USA, N.A. is a corporation with offices at
3700 WISEMAN BLVD. SAN ANTONIO TX 78251
2. Defendant is adult individual(s) residing at the address listed
below:
RICHARD A LOPEZ JR
6149 HAYMARKET WAY
MECHANICSBURG, PA 17050
3. Defendant applied for and received a credit card issued by
Plaintiff bearing the account number 5149232000006981 .
4. Defendant made use of said credit card and has a current balance
due of $5863.16 .
5. Defendant is in default of the terms of the Cardholder Agreement
having not made monthly payments to Plaintiff thereby rendering the
entire balance immediately due and payable.
6. Plaintiff avers that the Cardholder Agreement between the parties
provides that Plaintiff is entitled to the addition of interest at the
rate of 6.000 per annum on the unpaid principal.
7. Plaintiff avers that the Cardholder Agreement between the parties
provides that Defendant will pay Plaintiff's attorneys' fees.
8. Plaintiff avers that such attorneys' fees will amount to $1000.00
9. Although repeatedly requested to do so by Plaintiff, Defendant has
willfully failed and/or refused to pay the principal balance, and
accrued interest or any part thereof to Plaintiff.
Wherefore, the Plaintiff prays for judgment in its favor and
against Defendant RICHARD A LOPEZ JR INDIVIDUALLY in the amount
of $5863.16 with continuing finance charges thereon at the rate of
6.OOOg per annum from July 25, 2007 plus costs.

The Defense Manpower Data Center (DMDC) is an organization of the Department of Defense that
maintains the Defense Enrollment and Eligibility Reporting System (DEERS) database which is the
official source of data on eligibility for military medical care and other eligibility systems.
The Department of Defense strongly supports the enforcement of the Servicemembers Civil Relief Act
[50 USC5 Appx. §§ 501 et seq] (SCRA) (formerly the Soldiers' and Sailors' Civil Relief Act of 1940).
DMDC has issued hundreds of thousands of "does not possess any information indicating that the
individual is currently on active duty" responses, and has experienced a small error rate. In the event the
individual referenced above, or any family member, friend, or representative asserts in any manner that
the individual is on active duty, or is otherwise entitled to the protections of the SCRA, you are strongly

04/17/2009 10:05 AM -Mark Conklin, Deputy Sheriff, who being duly sworn according to law, states that on April 17,
2009 at 1055 hours, he served a true copy of the within writ of execution, upon the defendant, to wit:
Richard Lopez, by making known unto Richard Lopez, at 6149 Haymarket Way, Mechanicsburg,
Cumberland County, Pennsylvania 17055 its contents and at the same time handing to him personally the
said true and correct copy of the same. Upon serving the writ of execution, a levy was completed.
Postcard mailed to attorney and letter mailed to defendant on 04-27-09.
03/31/2010 Ronny R. Anderson, Sheriff, who being duly sworn according to law, states this writ of execution is
returned as ABANDONED. No action on writ in over 6 months.
