CUMBERLAND COUNTY BAR ASSOCIATION TVIIO LIBERTY AVENUE CARLISLE PA 17013 (717) 249-3166 STATE AUTO INSURANCE COMPANIES v Plaintiff IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 07-5155 ROBERT BOLASH individually and :CIVIL ACTION -LAW trading as BOLASH CONSTRUCTION & REMODELING Defendant(s) COMPLAINT The Plaintiff, STATE AUTO INSURANCE COMPANIES, by its attorneys, KODAK ~ IMBLUM, P.C., brings this action of Assumpsit against the Defendants to recover the sum of ONE THOUSAND SIX HUNDRED SIXTY-ONE DOLLARS ($1,661.00), along with interest thereon at the statutory rate from August 16, 2007, upon a cause of action of which the following is a statement: 1. The Plaintiff, STATE AUTO INSURANCE COMPANIES, is a corporation organized and existing under the laws of the State of Ohio, having its principal office and place of business at 518 East Broad Street, Columbus, OH 43215. 2. The Defendant, ROBERT BOLASH, individually and trading as BOLASH CONSTRUCTION & REMODELING, is an adult individual residing at 4525 Valley Road, Enola, Cumberland County, Pennsylvania 17025. 3. On or about May 23, 2003, Defendants submitted an application for insurance to Plaintiff and thereafter entered into a Series One Contractors Policy Application with F:\USER\ROBIN\CCP6cDJ CMFS\CCP COMPLAINTS\STATEAUTO 3?S37.wpd whereby Plaintiffwould provide the aforesaid insurance to Defendants forthe period of May 23, 2003 to May 23, 2004. Said policy was renewed for the periods May 23, 2004 to May 23, 2005 and May 23, 2005 to may 23, 2006. A true and correct copy of the May 23, 2003 Series One Contractors Policy Application is attached hereto, marked Exhibit "A" and made a part hereof. Said policy was cancelled for non- payment on or about November 10, 2005. 4. The prices charged for said insurance coverage was just and reasonable, was the legal and market prices therefor and was the price which the Defendants promised and agreed to pay to Plaintiff. 5. In consideration of the insurance coverage to be provided to Defendants by Plaintiff, Defendants paid to Plaintiff the sum of Six Hundred Four Dollars ($604.00) to being said coverage as set forth on Exhibit "B" attached hereto and made a part hereof. 6. Thereafter, Plaintiff has a company perform an audit of Defendants' policy, which audit was consented and agreed to by Defendants as set forth on Exhibit "C" attached hereto and made a part hereof. 7. As the result of the audit performed, Plaintiff charged Defendants the additional sum of One Thousand Five Hundred Twenty-Six Dollars ($1,526.00) for the insurance coverage to be provided.
