NOW COME the Defendants, L.B. Smith Lincoln Mercury, Inc. ("L.B. Smith") and
Forrest Brenneman (collectively "Defendants"), through their attorneys, Rhoads & Sinon LLP,
and file the following Joinder Complaint against Additional Defendant Metropolitan Direct
Property Casualty & Insurance Company d/b/a Metropolitan Property Casualty & Insurance
Company ("Metropolitan Property") stating as follows:

1. L.B. Smith is a Pennsylvania Corporation with its principal place of business
located at 6391 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17055.
Forrest Brenneman ("Brenneman") is an employee ofL.B. Smith.
2. Plaintiffs lung T. Lee and Alicia Lee are, upon information and belief, adult
married individuals with an address of64 Clemens Drive, Dillsburg, York County, Pennsylvania.
3. Upon information and belief, Metropolitan Property is an insurance company with
an office at 1101 West Dekalb Park, King of Prussia, Montgomery County, Pennsylvania 19406.
Metropolitan Property is engaged in providing insurance, including automobile insurance, in the
Commonwealth of Pennsylvania.
4. In April, 2001, L.B. Smith entered into an agreement with Plaintiffs Alicia Lee
and lung T. Lee ("Plaintiffs") wherein Plaintiffs agreed to purchase a vehicle, a 1998 Lincoln
VINNo. 1LNFM97V7WY60539, in exchange for total payment of$24,757.00.
5. Part of the purchase price included trade-in of Plaintiffs' vehicle, a 1992 Buick
Regal, insured through a policy issued by Metropolitan Property, Policy No. 202 58 88260. (A
copy of Plaintiffs' insurance card for the 1992 vehicle is attached hereto as Exhibit "A" and
incorporated herein by reference).
6. Upon Plaintiffs' purchase of the 1998 vehicle, L.B. Smith, through Mr.
Brenneman, notified Metropolitan Property of the purchase of the 1998 Lincoln and sale of the
1992 Buick RegaL
7. Specifically, by telephone call on April 30, 2001, Mr. Brenneman notified
Metropolitan Property of Plaintiffs' purchase of the 1998 vehicle.

8. Despite the actions of Mr. Brenneman and L.B. Smith, upon information and
belief, Metropolitan Property failed to take the steps necessary to transfer the policy to the 1998
Lincoln purchased by Plaintiffs.
9. Upon information and belief, following purchase of the 1998 Lincoln, Plaintiffs
were involved in an automobile accident which caused damage to the vehicle purchased from
L.B. Smith.
10. Upon information and belief, Plaintiffs' notified Metropolitan Property of the
accident and, despite the notice of the purchase of the 1998 Lincoln given to Metropolitan
Property by L.B. Smith, Metropolitan Property declined coverage under Policy No. 202 58
88260.
11. Following the denial of coverage, Plaintiffs instituted an action against LB. Smith
and Mr. Brenneman seeking damages in the amount of $5,494.72 allegedly sustained in the
accident. Specifically, Plaintiffs claim that they suffered damages by the failure of L.B. Smith to
ensure insurance coverage for the 1998 Lincoln and failure to advise Plaintiffs of any further
steps necessary to obtain insurance coverage. (A copy of the Complaint is attached hereto as
Exhibit "B" and incorporated herein by reference).
12. On October 29, 2003, Defendants filed an Answer and New Matter to Plaintiffs'
Complaint denying liability. (A copy of the Answer and New Matter is attached hereto as
Exhibit "c" and incorporated herein by reference).
13. In the event that it is determined that Plaintiffs have been damaged, as pled in
the above-referenced Complaint, an allegation which Defendants specifically deny, then

Defendants allege that such damages are as a result of the negligence and conduct of
Metropolitan Property.
14. In the event it is determined that Defendants L.B. Smith and/or Mr. Brenneman
have been damaged as a result of any determination of negligence or other conduct of
Metropolitan Property, then Metropolitan Property is liable to Defendants for said damages.
WHEREFORE, Defendants L.B. Smith Lincoln Mercury, Inc. and Forrest Brenneman
respectfully request that, in the event that it is determined that Defendant are liable to Plaintiffs,
which liability is specifically denied, it is averred that Metropolitan Property is solely liable to
Defendants or jointly and severally liable to Defendants for those damages.

1. Jung T. Lee and.Alicia Lee are adult individuals residing at 64 Clemens
Drive, Dillsburg, Pennsylvania.
2. Defendant L. B. Smith Lincoln Mercury, Inc. is a Corporation with Offices
located at 6391 Carlisle Pike, Mechanicsburg, PA
3. Defendant Forrest Brenneman is an adult individual who at all times
material to this action was an authorized agent, servant or employee for
Defendant L. B. Smith Lincoln Mercury, Inc. at the above address.
4. The events which form the basis of this action occurred on April 30,
2001, when the Plaintiffs purchased a 1998 Lincoln automobile from Defendant
L. B. Smith Lincoln Mercury, Inc. as more fully shown on a motor vehicle
installment sale Contract dated April 30, 2001, a copy of which is attached hereto
and which is hereby made a part hereof.
5. In this purchase transaction the Defendant L. B. Smith Lincoln Mercury,
Inc. was represented by its agent, servant or employee, Forrest Brenneman, who
was acting within the scope of his employment.
6..AB part of this transaction Forrest Brenneman advised the Plaintiffs that
it was necessary t.o provide insurance for the subject vehicle and that the
necessary insurance information was provided to Mr. Brenneman, who advised
the Plaintiffs that he would contact the Plaintiffs' insurance agent and arrange
to have the coverage transferred from the Plaintiffs' trade in vehicle, a 1992
Buick, to the 1998 Lincoln which was being Sold to the Plaintiffs. See Exhibit A.
7. Plaintiffs finA.nced the purchase of the subject vehicle through Waypoint
Bank, which finAncing was arranged by the Defendants, and which financing
required that the subject vehicle was to be insured, which insurance was to be
confirmed by the Defendants as evidenced by the "Statement of Insurance"
completed by the Defendants and presented to Plaintiffs for signature at the time
the vehicle was purchased. See Exhibit B.
8. Plaintiffs aver that they took no action to confirm the insurance coverage
with their agent because Mr. Brenneman had assured them that the insurance
'coverage was being transferred on April 30, 2001, when the vehicle was delivered
to the Plaintiffs by Defendants who also undertook the responsibility to title the
vehicle to Plaintiffs subject to the lien of Wa;ypoint Bank.
9. From and after April 30, 2001, Plaintiffs took possession of the subject
vehicle and operated the vehicle without question regarding the insurance
coverage since the temporary-insurance document issued to the Plaintiffs showed

that the insurance was in effect on 1998 Uncoln.
10. On August 1"1', 2001, the Plaintiffs were traveling in Baltimore,
Maryland, when they were involved in a collision, which was not caused by
Plaintiffs, With a 2001Ford truck Which had been stolen and which collision
severely damaged the vehicle of Plaintiffs.
11. The damages to the vehicle of Plaintiffs amounted to $S,494. "1'2, Which
should have been paid by the insurance With Metropolitan Property and Casualty
Insurance Company.
12. Plaintiffs made a claim to Metropolitan and were advised that there was
no coverage on the vehicle at the t1me of the accident since the vehicle had not
been covered at the time it was purchased.
13. As a result of the lack of insurance coverage on the vehicle the Plaintiffs
were requ.il:'ed to PBiY for the repairs to the sUDJect vehicle from their own fu:nds.
See Exhibit C.
14. Plaintiffs aver the Forrest Brenneman had affirmatively undertaken to
contact Metropolitan Property and CasuaJ.ty Ins\U'ance Company to make sure
that the 1998 Lincoln was covered and he failed to do so.
IS. Plaintiffs are informed that Forrest Brenneman had contacted the
Metropolitan Property and Casualty Insurance Company and had verified the
existence ofthe insurance coverage but failed to adVise Metropolitan that the new
vehicle was to be added and further failed to advise the Plaint1ffs that there was
anything remaining to De done by Pla.:l11tiffs to bind insurance coverage for
Plaint1ffs on the 1998 Lincoln.
16. Plaintiffs aver that they have suffered damages in the amount of
$5,494.72, as the result of the failure of Forrest Brenneman and L. B. Smith
Lincoln Mercury, In.c., to proceed with the undertaking made on April 30, 2001,
by Forrest Brenneman that he would have the 1998 Lincoln added to the
Plaintiffs insurance policy with Metropolitan Property and Casualty, Insurance

engaged in providing insurance, including automobile insurance, in the Commonwealth of Pennsylvania. The
remainder of the averment contained in this paragraph are denied.

5. It is admitted that PlaintiffJung T. Lee insured a 1992 Buick Regal through a policy issued by
Metropolitan Property, policy no. 202 58 88260. After reasonable investigation, answering defendant lacks

Paragraph and the same are therefore denied, strict proof being demanded at trial if relevant.
6. It is denied that L.B. Smith, through Mr. Brenneman, notified Metropolitan of the purchase ofthe
1998 Lincoln and sale of the 1992 Buick Regal. After reasonable investigation, answering defendant lacks
knowledge or information sufficient to form a belief as to the truth ofthe remaining averments contained in this
Paragraph and the same are therefore denied, strict proof being demanded at trial if relevant.

18. Additional Defendant, Metropolitan was not properly joined in this action by the original defendants.
19. In the event that it is determined that Additional Defendant, Metropolitan was properly joined in this
action, the joinder was effectuated beyond the applicable statute oflimitations, and, therefore, Plaintiffs may
not recover directly against the Additional Defendants.
20. Original defendants lack standing to bring an action against the Additional Defendants.
21. Answering Additional Defendant was not negligent.
22. Any acts or omissions of answering defendant alleged to constitute negligence were not substantial
causes or factors in bringing about Plaintiffs alleged harm.
23. The incident and/or damages described in Plaintiffs complaint may have been caused or contributed
to by Plaintiff and/or original defendants.
24. The negligent acts or omissions of other individuals and/or entities may have constituted intervening
superseding causes of the damages and/or injuries alleged to have been sustained by the Plaintiffs.
25. The negligent acts or omissions of other individuals and/or entities may have caused Plaintiffs
damages.
26. The incident and/or damages alleged to have been sustained by Plaintiff were not proximately
caused by answering Additional Defendant.
27. Plaintiffs may not have properly mitigated their damages.
28. Neither Plaintiff has standing to bring this cause of action.
WHEREFORE, answering Additional Defendants respectfully requests that Plaintiffs Complaint and
the Joinder Complaint against Additional Defendants be dismissed with prejudice.

30. If the allegations of Plaintiffs' Complaint are proven true at the time of trial, or other adjudication,
the same of which are hereby specifically denied by this Defendant, then Plaintiffs' damages, if any, were
caused in whole or in part by the negligence and/or breach of contract of original defendants, L.B. Smith
Lincoln Mercury, Inc. and Forrest Brenneman, and/or all other liability producing conduct ofthe original
defendants and not Additional Defendant Metropolitan.
31. As a result of the aforementioned liability producing conduct on the part of the original defendants,
original defendants are solely liable to Plaintiff, jointly and/or severally liable and/or are liable to additional
defendant for contribution and/or indemnification.
WHEREFORE, answering defendant, Metropolitan respectfully requests that this Honorable Court enter
judgment in its favor and against all other parties.

17. While this averment sets forth a conclusion o:f law to which no answer is
required, to the extent the Court deems a rasponse necessary, Plaintiffs
aver that the damages they sustained were the direct and proximate
result of the omissions of Forrest Brennemlb1in that it was necessary to
verify insurance for the subject vehicle whi~h was being financed and
that the necessary insurance information W)as provided to Mr.
Brenneman, who advised the Plaintiffs that ihE~ would contact the
Plaintiffs' insurance agent and arrange to hj:l.ve the coverage transferred
from the Plaintiffs' trade in vehicle, a 19921Buick, to the 1998 Lincoln
which was being sold to the Plaintiffs but Fdrrest Breneman failed to
follow through with his undertaking. Strict proof of the averment is
hereby demanded.
18. While this averment sets forth a conclusion of law to which no answer is
required, to the extent the court deems a reflponse necessary, Plaintiffs

aver that there is a direct connection betweEm. the damages suffered by
Plaintiffs and the lack of action or omissions of the Defendants who
undertook to bind insurance on the subject vehicle.
The failure to act by the Defendants resulted in the damages suffered by
Plaintiffs. Strict proof of the averment is hereby demanded.

aver that their claims are not barred by the statue of frauds because this
action has nothing to do With any provision of the statue of frauds and
therefor it does not apply. Strict proof olf the averment is hereby
demanded.
24. While this averment sets forth a concluSion of law to which no answer is
required, to the extent the court deems: a response necessary, Plaintiffs
aver that their claims are not barred by l~3.Ches due to the fact that this is
not an equity action. Laches is not a proper defense and is not relevant
in the instant action. Strict proof of the a;verment is hereby demanded.

aver that their claims are not barred by tihe statue of l1m1tations when
the action was brought in district magistrate court Within two years of

ANSWER: The items of dameage claimed by Plillinitffs are fully detailed in
the Complaint and represent the costs to repair the subject vehicle, which repair
work was performed by Defendant.
3. State with particularity the factual basis for each claim or defense you are
asserting in this case.
ANSWER: As alleged in the Complaint, Plainitff~; purchased the subject
vehicle and arranged financing through the Defendant. Forrest Brenneman
advised the Plaintiffs that he would arrange to have the necessary insurance
coverage placed on the vehicle through the Plaintiffs insurance company and he
failed to do so which failure resulted in there being nlo insurance coverage upon
the vehicle when it was subsequently damaged in a collision with an uninsured
vehicle in Baltimore, Maryland. Plaintiffs relied to their detriment, upon the
representations of Forest Brenneman, that he would I~roceed to have the
insurance transferred, when he failed to do so and further failed to notify either
Plaintiffs or the auto loan lender that there was no insurance in effect.
4. If you know of anyone that has given any statement (as defined by the Rules of
Civil Procedure) concerning this action or its subject matter, state:

ANSWER: Plaintiffs have no knowledge of any ~such statements.

would contact the Plaintiffs' insurance agent and arrange to have the coverage
transferred from the Plaintiffs' trade in vehicle, a 1992 Buick, to the 1998 Lincoln
which was being Sold to the Plaintiffs." With respect to such allegation, please
state each fact or circumstance which you contend supports this contention,
identify each witness with knowledge relative to this contention, and identify each
document which discusses, refers to, or in any way pertains to the information
contained in said allegation.
ANSWER: The only witnesses to this occurrence are believed to be Mr.
Brenneman and the Lees.
16. In Paragraph 8 of your Amended Complaint you state, "Plaintiffs aver that they
took no action to confirm the insurance coverage with their agent because Mr.
Brenneman had assured them that the insurance coverage was being
transferred on April 30, 2001, when the vehicle was delivered to the Plaintiffs by
Defendants who also undertook the responsibility to title the vehicle to Plaintiffs
subject to the lien of Waypoint Bank." With respect to such allegation, please
state each fact or circumstance which you contend supports this contention,
identify each witness with knowledge relative to this contention, and identify each
document which discusses, refers to, or in any way pertains to the information
contained in said allegation.
ANSWER: Plaintiffs contend that the vehicle documents issued to them when the
vehicle was turned over to them indicate that there was insurance coverage
consistent with the representations made by Forrest Eirenneman. Plaintiffs
contend that the very act of releasing the vehicle to Plaintiffs indicated that the
Defendants had a high level of confidence that all actions necessary to conclude
the sale transaction had been accomplished, including the obtaining of insurance
to protect the vehicle loan lender and the purchasers.
17. In paragraph 9 of your Complaint you state, "the temporary insurance document
issued to the Plaintiffs showed that the insurance was in effect on the 1998
Lincoln." With respect to such allegation, please state each fact or circumstance
which you contend supports this contention, identity each witness with
knowledge relative to this contention, and identify Elach document which
