Dietz (the "Estate") and Berniece B. Dietz and D. Stoner Dietz, heirs of the Estate of Barbara J. Dietz, WITNESSETH: WHEREAS, Barbara J. Dietz died February 26,2007, survived by her parents, Berniece B. Dietz and D. Stoner Dietz.; and WHEREAS, Letters of Administration were granted to John E. Slike, as Administrator, on March 7, 2007; and WHEREAS, the undersigned, being all of the heirs of Barbara 1. Dietz, wish to settle the Estate by agreement rather than by a formal accounting; NOW, THEREFORE, in consideration ofthe mutual covenants of the parties, all parties intending to be legally bound hereby, it is agreed as follows: 1. An accounting of the receipts and expenditures in the Estate is attached hereto. 2. Each of the undersigned has been fully advised of his or her rights pertaining to the filing of an account and both do hereby waive any right that they may have to compel an accounting prior to the distribution of the estate. 3. Each of the undersigned accepts and approves the attached accounting and agrees that this agreement shall have the same force and effect as if a formal accounting had been filed with and confirmed by the Orphans' Court of Cumberland County. 4. Each of the undersigned agrees that distribution shall be in accordance with the attached schedule. 5. We, Berniece B. Dietz and D. Stoner Dietz, and each of us, in consideration of the promise to the other, do hereby agree to refund to the estate, pro-rata, any amount which may be necessary in the future to discharge any liabilities of the estate of which we may hereafter receive notice. 6. We, Berniece B. Dietz and D. Stoner Dietz, do hereby release the Administrator of and from any and all claims we may have under the law against the Estate of Barbara J. Dietz or against John E. Slike, the Administrator, thereof. 7. This agreement may be executed in multiple counterparts, and when so executed, shall be binding upon the parties and their respective heirs, personal representatives, and assigns.
