STIPULATION AGAINST LIENS
THIS AGREEN~NT made this ~ day of ~ S1- , 2007, by
and between
ROLAND BUILDER, INC. hereinafter referred to as Contractor,
AND
RICHARD A. SAJAC AND ANN D. SAJAC, husband said wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a single family dwelling situate in Lower
Allen Township, Cumberland County, Pennsylvania and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot 10, Liberty Point, Mechanicsburg, PA.
NOW THEREFORE, THIS AGREEL~NT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract on lot of land situate in Lower Allen Township,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin on the dedicated right of way line of Liberty Cove cul-
de-sac at the dividing line of Lot 10 herein conveyed and Lot 9 as shown on the
hereinafter mentioned Subdivision Plan; thence along Liberty Cove cul-de-sac on a
curve to the left with a radius of 60 feet, an arc length of 50.04 feet, a chord bearing
of North 03 degrees 47 minutes 11 seconds West, and a chord length of 4$.61 feet to
an iron pin at the dividing line of Lot 11; thence along. Lot 11 North 62 degrees 19
minutes 11 seconds East, a distance of 411.87 feet to an iron pin on the dividing line
of lands now or formerly of Brandt; thence along. said lands South 00 degrees 57
minutes 33 seconds East, a distance of 718.15 feet to an iron pin at or near the bank
of the Yellow Breeches Creek; thence along at or near the bank of the Yellow
Breeches Creek North 71 degrees 23 minutes 06 seconds West, a distance of 79.39
feet to an iron pin; thence North 74 degrees 22 minutes 33 seconds West, a distance
of 125.23 feet to an iron pin fat the dividing line of Lot 9; thence along Lot 9 North 00
degrees 57 minutes 33 secodds West a distance of 356.33 feet to an iron pin; thence
North 69 degrees 53 minutes 33 seconds West, a distance of 182.90 feet to an iron
pin on the dedicated-right of way line of Liberty Cove cul-de-sac, the Place of
BEGINNING.
SUBJECT to wetland cons~rvativn easements, steep slope easements, a woodland
preservation easement, conservation easements and atwenty-five (25) feet wide
maintenance/trail easement as shown on Plan.
CONTAINING an area of 63,460 square feet or 1.46 acres and being Lot 10 on the
Final Subdivision Plan for Liberty Point dated December 19, 2005, prepared by
Madden Engineering Services, Inc. and recorded in Recorder of Deeds Cumberland
County in Plan Book 92, Page 136.
