Estate of Rita N. Fox, (/) ~ - - 'P.: > - - .- - I.J:) FAMILY SETTLEMENT AND FINAL RELEASE ESTATE OF RITA N. FOX~ DECEASED KNOW ALL MEN BY THESE PRESENTS, that Rita N. Fox, late of Lower Allen Township, Cumberland County, Pennsylvania, deceased, died testate on November 25, 2006, having first made her Last Will and Testament, which was duly executed on February 7, 2006 and probated in the Office of the Register of Wills of Cumberland County, on December 5, 2006. WHEREAS, the said Rita N. Fox, by the aforesaid Last Will and Testament, named Quentin DeWalt Novinger as Executor of said Last Will and Testament and James M. Novinger as Alternate Executor of said Last Will and Testament; WHEREAS, the said Quentin DeWalt Novinger renounced his right to serve as Executor of said Last Will and Testament; WHEREAS, Letters Testamentary on the Estate of the said decedent were duly issued by the Register of Wills of Cumberland County, Pennsylvania, to James M. Novinger, also known as James N. Novinger, as Executor, hereinafter called personal representative; WHEREAS, the personal representative has gathered the assets of the Estate of the said decedent, paid all obligations of the said decedent and her estate with the exception of certain anticipated obligations for which a reserve has been established, and has caused to be prepared and filed a Pennsylvania inheritance tax return, and has prepared a first and final account, a copy of which has been provided to each of the named beneficiaries of the Estate of decedent; WHEREAS, Sandra Itterly, Rita Sue Fultz, and Quentin DeWalt Novinger, are the heirs of the Estate pursuant to the terms ofthe Last Will and Testament of the said decedent; and WHEREAS, Sandra Itterly, Rita Sue Fultz, and Quentin DeWalt Novinger hereby 4 ~ ~ acknowledge that they are in receipt of a copy of the decedent's Will, the Inventory filed of record with the Register of Wills of Cumberland County, the Pennsylvania Inheritance Tax Return filed and approved by the Executor and a First and Final Account which includes a proposed Schedule of Distribution of remaining assets of the decedent. NOW, THEREFORE, Sandra Itterly, Rita Sue Fultz, and Quentin DeWalt Novinger, being the sole and only heirs under the Last Will and Testament of the said decedent, and being the only persons entitled to inherit under said Last Will and Testament, do hereby acknowledge that they have this day had and received from the aforesaid personal representative, in full satisfaction and payment of all sums of money, legacies, bequests, and devises as are given, devised and bequeathed to each of us respectively by the said Last Will and Testament, the amounts due to them under said Last Will and Testament as set forth in the Schedule of Distribution, except for each respective beneficiary's pro rata share of any unused reserves set forth in said proposed distribution; and do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we agree that no account is necessary and we do hereby agree that we do consent to distribution being made without the filing of an account and schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas of Cumberland County, Pennsylvania. THEREFORE, we do hereby remise, release, quitclaim and forever discharge the said personal representative, James M. Novinger, also known as James N. Novinger, his heirs, executors, administrators and assigns, of and from the said estate and from all actions, suits, payments, accounts, reckonings, claims, and demands whatsoever for or by reason thereof, except for each respective beneficiary's pro rata share of any unused reserves set forth in said proposed distribution, or for any other use, matter, cause or thing whatsoever, touching upon the Estate of the said decedent, and we do further hereby covenant and agree that should any liability come due to the estate of the said decedent after the signing of this Agreement, we do hereby covenant and agree that we will contribute to the Estate to satisfy any and all claims, demands, suits, or causes of action which may be successfully prosecuted against the said Estate or the aforesaid personal representative after the signing, sealing and delivery of this Family Settlement Agreement and Final Release. THIS AGREEMENT may be executed by the parties in multiple counterparts and shall become effective when executed by all parties hereto.
