Worley, Petitioners, through their attorney, Daniel D. Worley, Esquire, with offices located at 101 East Philadelphia Street, York, Pennsylvania 17401, and files the following Petition pursuant to 36 P.S. §§ 2731-2763, and states: 1. Petitioners aze adult individuals with a mailing address of 225 Latimore Valley ~I; Road, York Springs, Pennsylvania 17372. 2. Petitioners are the record owners of real property located in South Middleton Township, Cumberland County, Pennsylvania, as is more fully set forth in the descriptions contained in the following deed from Francis Worley, Jr. and Daniel T. Worley, Co-executors of the Estate of Francis Worley to Francis Worley, Jr. and Daniel T. Worley, Petitioners, dated April 27, 2004 and recorded in the Office of the Recorder of Deeds in Cumberland County in Deed Book 262, page 3636, and attached hereto as Exhibit "A." 3. Respondent Kenneth R. Whitson, with a mailing address of 74 Smith Road, Gardners, Pennsylvania 17324, is the record owner of a parcel of land in South Middleton Township, Tax Parcel No. 40-15-0201-009, as is more fully set forth in a description of a deed from Grace A. Whitson to Kenneth R. Whitson, dated November 29, 1.999, and recorded in the Office of the Recorder of Deeds of Cumberland County in Deed Book 212, page 334. See Exhibit "B" attached. 4. Petitioners' property is land-locked, and Petitioners have neither a private nor a public access road to Petitioners' tract of land. 5. An existing gravel road leads from Smith Road, a public road, through property owned by Jeffrey A. Fahnestock and Michelle L. Fahnestock, Tax Pazcel No. 40-15-0201-014. 6. Petitioners have an existing private easement for this unimproved road through the property owned by Jeffrey A. Fahnestock and Michelle L. Fahnestock, dated July 19, 2005, and recorded in the Office of the Recorder of Deeds on August 5, 2005. See Exhibit "C" attached. 7. The road continues in a northerly direction through property owned by Roy L. Collaze and Debra A. Collaze, Tax Pazcel No. 40-15-0201-013. 8. Petitioners have an existing private easement for this unimproved road through the property owned by Roy L. Collare and Debra A. Collaze, dated July 19, 2005, and recorded in the Office of the Recorder of Deeds on August 5, 2005. See Exhibit "D" attached. 9. The road continues in a northerly direction through property owned by Calvin W. Group and Phyllis D. Group, Tax Parcel No. 40-15-0201-016. 10. Petitioners have an existing private easement for this unimproved road through the property owned by Calvin W. Group and Phyllis D. Group, dated August 2, 2005, and recorded in the Office of the Recorder of Deeds on August 5, 2005. See Exhibit "E" attached. 2 11. The road continues in a northeast direction through property owned by Kenneth R. Whitson, Respondent, to the southwest border of Petitioners' property. 12. The shortest and most practical route from a public road to Petitioners' land is across this existing gravel road. See Exhibit "F" attached. 13. The opening of a private road across Respondent's land for use by Petitioner is necessary for Petitioner to have access to their land from a public road. WHEREFORE, Petitioners respectfully request that this Honorable Court appoint three viewers to lay out a private road leading from Petitioners' real property located in South Middleton Township, Cumberland County, Pennsylvania, and to assess the damages, if any, to which any party may be entitled.
