Logan, individually and as Executor ofthe Estate of Virginia A. Logan and the beneficiaries of the Estate. BACKGROUND A. Virginia A. Logan died with a will on September 19,2005. B. On September 22,2005, Letters Testamentary were granted unto Donald J. Logan to administer the Estate. The Will number for the estate with the office of the Register of Wills in and for the County of Cumberland is 2005-0849. C. It is the desire of the parties to this Agreement that the fmal distribution ofthis estate be accomplished without a formal accounting to the Orphan's Court division ofthe Court of Common Pleas of Cumberland County, it being the desire of the parties to avoid expense, delay, and publicity of a formal accounting. Now, therefore in consideration of the mutually promises, covenants, and agreements recited herein, the parties intending to be legally bound hereby do agree as follows: 1. The parties in interest are as follows: (i) Donald J. Logan (ii) Laura R. Gorecki (iii) Sandra B. Bell (iv) Elizabeth A. Rothermel Each of the above-identified beneficiaries in interest are entitled to a one-fourth distributable share of the estate subject to probate, or as modified in accordance with the Last.Will and Testament of Virginia A. Logan. 2. Each of the parties to this agreement have been furnished with a complete listing of the Estate assets and disbursements and schedule of distribution, as more fully described in the attached Schedules Al and A2. 3. Each of the parties to this agreement does hereby release and forever discharge Donald 1. Logan from any and all liability which may from time to time arise in connection with his services as Executor of the Estate of Virginia A. Logan, deceased. The parties do further agree to indemnify and hold said Donald J. Logan, Executor harmless from any and all liability, which may arise against the Estate from creditors or other claimants. 4. Each ofthe parties does hereby acknowledge that distribution will be made to the parties consistent with Schedules Al and A2 and accepts such proposed distribution. 5. Each party to this agreement acknowledges that this agreement may be indexed and recorded in the estate proceedings and that the terms hereof shall be binding upon the respective heirs, successors, administrators and assigns. EACH BENEFICIARY IS CONSIDERED A ONE-FOURTH OWNER OF THE SCOOTER. PERSONAL PROPERTY ALL PERSONAL PROPERTY OF THE ESTATE HAS BEEN EaUALL Y DIVIDED BETWEEN THE BENEFICIARIES AND NO BENEFICIARY WILL HAVE ANY FUTURE CLAIMS AGAINST THE ESTATE OR ANY BENEFICIARY FOR ANY PERSONAL PROPERTY.
