THIS AGREEMENT made the 19th day of September, 2003, by and between S & S DREAM
BUILDERS, a Pennsylvania Partnership, hereinafter referred to as Contractor, and WADE E.
REALL, JR. and ERICA F. REALL, hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a custom built home on that certain lot of ground situate at North
Newton Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached
hereto and made a part hereof.
NOW THEREFORE, WlTNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrmment, waiving the right of lien, shall be an independent covenant.

ALL that certain tract of land situate in North Newton Township, Cumberland Comity,
Pennsylvania, known and numbered as Lot No. 21 on certain Subdivision Plan for Jeungyen
Van Scyoc, filed July 15, 1993, in Cumberland County Plan Book 66, Page 78, being more
particularly heralded and described as follows:
BEGINNING at a parker kalon nail in the right-of-way of township Road T-333, Springfield
Road, thence aiong Lot 14 and Lot No. 20 on the aforesaid plan, North 41 degrees 30 minutes 02
seconds West 1028.21 feet (passing through an iron pin on line set 25.01 feet from the aforesaid
parker kalon nail) to an iron pin; thence along lands now or formerly of Thomas Trez, North 75
degrees 38 minutes 09 seconds East 162.75 feet to an existing stone; thence along lands now or
formerly of Reuben M. Zimmerman, North 42 degrees 57 minutes 42 seconds East 109.82 feet to
an iron pin; thence along Lot No. 22 on the aforesaid subdivision plan, South 43 degrees 40
minutes 19 seconds East 329.52 feet to an iron pin; thence along Lots Nos. 16 and 15 on the

30 minutes 02 seconds East 624.14 feet to a parker kalon nail in the c enterline of T-333,
Springfield Road, (passing through an iron pin on line set 25.01 feet from the aforesaid parker
kalon nail); thence over the centerline of T-333, Springfield Road, South 47 degrees 15 minutes
30 seconds West 50.01 feet to a parker kalon nail, the point and place of BEG~'N1NG,
CONTAINING 2.7968 acres, mom or less.
