STIPULATION AGAINST DENS
NOW, September 12, 2007, before any authority has been given by the said Owner to the said
Contractor to commence work on the said improvements or purchase materials for the same, in
consideration of the making of the said contract with Owner and the further consideration of One Dollar
($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against said property by the
Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the installation and construction of
said muniapal improvements, the right to file such liens being expressly waived.

JEANNETTE L. MAGARO and RICCI S. MAGARO, adult individuals residing at 614 Robert Street,
Mechanicsburg, Pennsylvania, hereinafter called "Owner", have entered into a contract with R. HART
ENTERPRISES, INC., a Pennsylvania Corporation with its principal place of business at 5154 Kylodc Road,
Mechanicsburg, Pennsylvania, hereinafter called "Contractor'", for the erection of a single family residential
dwelling upon land of Owner situate in Lower Allen Township, Cumberland County, Pennsylvania, being
more particularly bounded and described on Exhibit "A," attached hereto and made part hereof.

EXHIBIT "A"
ALL THAT CERTAIN tract or parcel of land situate in Lower Allen Township,
Cumberland County, Pennsylvania, being more particularly bounded and describe
follows:
BEGINNING at the southeasterly comer of Lot 9 of the aforesaid The Village at
Fair Oaks, said point also being the common comer between Lot 9 and Lot 10 and
along the northern right of way of Whitlock Lane by a curve to the right having a
radius of 35.00 feet an arc length of 34.58 feet with a chord bearing of South 55
degrees 19 minutes 43 seconds East a distance of 33.19 feet; thence along the
northern right of way line not Ravenwood Road South 86 degrees 45 minutes 11
seconds West a distance of 5.46 feet; thence along said right of way of
Ravenwood Road by a curve to the left having a radius of 175.00 feet an arc
length of 39.58 feet with a chord bearing of South 79 degrees 44 minutes 44
seconds West a distance of 39.49 feet; thence along lands now or formerly of
Rossmoyne Residential Associates North 35 degrees 30 minutes 15 seconds
West a distance of 149.20 feet; thence along lands now or fom~eriy of Erie
Indemnity Company North 54 degrees 30 minutes 00 seconds East a distance of
73.55 feet; thence along. Lot 9 South 35 degrees 30 minutes 15 seconds East a
distance of 169.44 feet to the point of BEGINNING.
CONTAINING 12,088 square feet.
BEING Lot No. 10 depicted on the Final Subdivision Plan for The Village at
Fair Oaks, prepared by Alpha Consulting Engineers, Inc., and recorded in the
Office of the Recorder of Deeds for Cumberiand County, Pennsylvania in Plan
Book 93, Page 84.
