D7 ,Sys ~ (',~„,7 ~~ MORTGAGE FORECLOSURE And now, comes the Plaintiff, Sovereign Bank, F.S.B., successor to Waypoint Bank, successor to Harris Savings Bank, by and through its attorney, Thomas A. Capehart, Esquire, and in support of the within causes of action avers as follows 1. Plaintiff, Sovereign Bank, F.S.B., ("Bank") is a Pennsylvania Banking Corporation with an office located at 601 Penn Street, Reading, Pennsylvania 19601. 2. Hazel A. Seidle is an adult individual currently residing at 422 Appletree Road, Camp Hill, Cumberland County, Pennsylvania 17011. 3. George E. Seidle, Jr., is an adult individual currently residing at 813 Wertzville Road, Enola, Cumberland County, Pennsylvania 17025. 4. The Defendant, George E. Seidle, Jr., is the owner of certain real property located at 813 Wertzville Road, Enola, Cumberland County, Pennsylvania and more specifically described in Exhibit "A" which is attached hereto and incorporated herein. 5. On January 2, 2001, George E. Seidle, died thereby vesting title to the Premises solely in Hazel A. Seidle by operation of law. 6. On or about September 21, 2000, George E. Seidle and Hazel A. Seidle executed and delivered an Open-end Mortgage to Plaintiff upon the Premises, which Mortgage was recorded on September 22, 2000 in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, at Mortgage Book Volume 1640, Page 169, et. seq. (the "Mortgage"). A true and correct copy of the Mortgage is attached hereto, marked as Exhibit "B", and incorporated herein. 7. The Mortgage has not been assigned by the Plaintiff. 8. The Mortgage was given as collateral security for a loan to George E. Seidle, Sr.(Deceased), Hazel A. Seidle and George E. Seidle, Jr., as evidenced by a Home Equity Line of Credit Agreement executed by the Defendants and George E. Seidle, Sr.,(Deceased), on September 21, 2000 in the principal amount of Ninety-five Thousand Dollars ($95,000.00) (the "Note"). A true and correct copy of the Note is attached hereto, marked as Exhibit "C", and incorporated herein. 9. On or about May 8, 2002, Hazel A. Seidle transferred ownership of the Premises in violation of the terms of the Mortgage, to George E. Seidle, Jr., pursuant to a Deed recorded on August 22, 2002 in the Office for the recording of Deeds in and for Cumberland County at Deed Book Volume 253, Page 1327 10. Due to the death of George E. Seidle, Sr., and pursuant to PA R.C.P. 1144 (b), the Plaintiff hereby releases George E. Seidle, Sr., from any personal liability for the debt secured by the mortgage. 11. The Defendants, Hazel A. Seidle and George E. Seidle, Jr., have failed to pay to the Bank the monthly mortgage payments of principal and interest due with regard to the Note and Mortgage since January 11, 2007. 12. Because of the aforesaid default, on or about May 18, 2007 an Act 91 Notice of Default to take action to save your home from foreclosure was mailed to the Defendant, Hazel A. Seidle, by certified mail, return receipt requested, wherein Plaintiff demanded that the Defendant, Hazel A. Seidle, make a payment of $5,287.74 as required by the Mortgage in order to cure the aforesaid default. A true and correct copy of the said Act 91 Notice is attached hereto and marked as Exhibit "D", and incorporated herein. 13. A copy of the Verification Notice pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. Section 1692, is attached hereto, marked as Exhibit "E", and incorporated herein. 14. Defendants have failed to pay the amount demanded in the Act 91 Notice. 15. As a result of the Defendant's failure to pay the amount demanded in the Act 91 Notice, the following amounts are now due pursuant to the terms of the Note and Mortgage Principal Balance $ 94,868.34 Interest to 08/15/07 4,552.11 Late Charges 693.52 Misc. Fees 400.25 Satisfaction fee 27.00 Attorney Fees & Costs 1,120.00 TOTAL $101.661.22 WHEREFORE, Plaintiff demands a judgment in Mortgage Foreclosure in its favor and against the Defendants in the amount of $101,661.22, plus per diem interest ($21.44) from August 15, 2007, late charges, costs of foreclosure and sale of the property and costs of this proceeding. Two aspects of the recommendation merit comment. 1. Rule of civil Procedure New Rule of Civil Procedure 230.2 has been promulgated to govern the termination of inactive cases within the scope of the Pennsylvania Rules of Civil Procedure. The termination of these cases for inactivity was previously governed by Rule of Judicial Administration 1901 and local rules promulgated pursuant to it. New Rule 230.2 is tailored to the needs of civil actions. It provides a complete procedure and a uniform statewide practice, preempting local rules. This rule was promulgated in response to the decision of the Supreme Court in Shop v. Eagle, 551 Pa. 360,710 A.2d 1104 (1998) in which the court held that "prejudice to the defendant as a result of delay in prosecution is required before a case may be dismissed pursuant to local rules implementing Rule of Judicial Administration 1901." Rule of Judicial Administration 1901(b) has been amended to accommodate the new rule of civil procedure. The general policy of the prompt disposition of matters set forth in subdivision (a) of that rule continues to be applicable. II Inactive Cases The purpose of Rule 230.2 is to eliminate inactive cases from the judicial system. The process is initiated by the court. After giving notice of intent to terminate an action for inactivity, the course of the procedure is with the parties. If the parties do not wish to pursue the case, they will take no action and "the Prothonotary shall enter an order as of course terminating the matter with prejudice for failure to prosecute." If a party wishes to pursue the matter, he or she will file a notice of intention to proceed and the action shall continue. a. Where the action has been terminated If the action is terminated when a party believes that it should not have been terminated, that party may proceed under Rule230(d) for relief from the order of termination. An example of such an occurrence might be the termination of a viable action when the aggrieved party did not receive the notice of intent to terminate and thus did not timely file the notice of intention to proceed. The timing of the filing of the petition to reinstate the action is important. If the petition is filed within thirty days of the entry of the order of termination on the docket, subdivision (d)(2) provides that the court must grant the petition and reinstate the action. If the petition is filed later than the thirty-day period, subdivision (d)(3) requires that the plaintiff must make a showing to the court that the petition was promptly filed and that there is a reasonable explanation or legitimate excuse both for the failure to file the notice of intention to proceed prior to the entry of the order of termination on the docket and for the failure to file the petition within the thirty-day period under subdivision (d)(2). B. Where the action has not been terminated An action which has not been temvnated but which continues upon the filing of a notice of intention to proceed may have been the subject of inordinate delay.
