I)r nu; ~ Montgamcrv County~'mttii»x~t:iry COMPLAINT FOR CONFESSION OF JUDGMENT Plaintiff files this Complaint pursuant to PA.R.C.P. 1951 (b) for judgment by confession and avers the following: Plaintiff is a Pennsylvania Corporation with its principal place of business located at 1566 Medical Drive, Suite 201, Pottstown, PA 19464-3229. Plaintiff was formerly known as Patriot Commercial Leasing, Inc. Defendants, Idriz Hrnjie and Elvir Hmjic, are both adult individuals residing at 6 Kingsbridge Court, Carlisle, PA 17013. They are both owners of the fictitiously named Idriz Hrnjic and Elvir Hmjic Trucking. The instrument attached hereto and made apart hereof as Exhibit "A." is a true and ~j ~~ correct copy of the original instrument containing a Warrant of Attorney authorizing the entry of (Page 2 of 7) judgment by confession. 4. The judgment sought herein is not being entered by confession against a natural person in connection with a consumer credit transaction. S. The attached instrument has not been assigned. 6. Judgment has not been entered on the instrument in any jurisdiction. 7. The attached instrument authorizes the immediate entry of judgment against the named Defendant upon the occurrence of default. 8. On December 1, 200b, Defendants, Idriz Hrnjic and Elvir Hrnjic; defaulted by failing to pay monthly installments due of $1,062.90. 9. Consequently, the Defendant is liable to the Plaintiff as follows: (a) Unpaid balance of the instrument $ 14 .0 (b) Authorized late charges $ 435.b9 (c) Authorized ZO% attorney's fee $ 10.716.38 (d) Total $ 64 .07 WHEREFORE, Plaintiff demands Judgment in the sum of $64,297.07 as authorized by the Warrant of Attorney appearing in the attached instrument plus costs.
