WHEREAS, Welimon Medical Center, Dr. Baxter Drew Welimon, II, Baxter Drew Welimon,
and Chester & Cumberland Investments LLC, 127 Walnut Bottom Road, Shippensburg,
Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a
contract, with McCoy Brothers, inc., of 1514 Commerce Avenue, Carlisle, Cumberland
County, Pennsylvania, for a new Medical Office Building, Lot #4-2, Progress Boulevard,
Shippensburg, Cumberland County, Pennsylvania.
NOW, at the time of and immediately before the execution of the principal contract, and
before any authority has been given by the said Weilmon Medical Center to the said
McCoy Brothers, inc. to commence work on the said building, or purchase materials for the
same in consideration of the tricking of the said contract with Welimon Medical Center and
the further consideration of One Dollar, to be paid by Weilmon Medical Center, it is agreed
that no limit .shall be flied against the building by the Contractor, or any sub-contractor, nor
by any of the material men or workmen or any other person for any labor, or materials
purchased, the right to file such liens being expressly waived.
