COMPLAINT
The Plaintiff, Debra A. Englebright, is an adult individual residing at 229 N.
Market Street, Duncannon, Pennsylvania 17020.
The Defendant, Rosa Reyas, is an adult individual residing at 4626 Mews
Hill Drive, Roanoke, Virginia 24019.
The facts and occurrences hereinafter related took place on or about July
12, 2002 in the parking lot of the Summerdale Plaza, Enola, Cumberland
County, Pennsylvania.
At the time and place aforesaid, Plaintiff was the owner and operator of a
1999 Chevrolet S10 truck which was then and there traveling in the aisle
of the parking lot.
At the time and place aforesaid, Defendant was the owner and operator of
a 1992 Geo Tracker which was then and there backing out of a parking
space.
As the Plaintiff was traveling in the aisle, Defendant backed out of a space
and struck the Plaintiff's vehicle on the passenger side.
7. The aforesaid accident and damages resulting therefrom were caused by
the negligence of Defendant Reyas in that she:
(a) Failed to keep a proper lookout for other vehicles
(b) Failed to yield the dght of way
8. Solely as a result of Defendant's negligence, Plaintiff sustained damages
in the amount of $1112.87 for repairs of her vehicle as well as rental of
another vehicle while repairs were being made.
WHEREFORE, Plaintiff requests damages in an amount not in excess of
mandatory arbitration.
