WHEREAS, Michael R. Burnett, of Cumberland County, Pennsylvania (herein
"Owner") is about to execute contemporaneously herewith, a contract, with Pollard &
Company, Inc. of Cumberland County, Pennsylvania (herein "Contractor"), for the
construction of a building upon Lot No. 79, Ashcombe Farms, P.R,D., Upper Allen
Township, Cumberland County, Pennsylvania, more particularly set forth on Exhibit "A"
attached hereto and made a part hereof.
NOW, September /,.[ 2003, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by said
Owner to the said Contractor to commence work on the said building, or pumhase
materials for the same in consideration of the making of the said contract with Owner
and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner
it is agreed that no lien shall be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material-men or workmen or any other person for any
labor, or materials pumhased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.

EXHIBIT "A"
ALL THAT CERTAIN piece or parcel of land situated in Upper
Allen Township, Cumberland County, Pennsylvania, more particularly bounded
and fully described as follows:
BEGINNING at a point located on the southern right-of-way line of
Cocklin Court, and a front corner of Lot No. 80:
THENCE along said right-of-way, North Sixty-six Degrees Fifty-five
Minutes Forty-six Seconds East a distance of Seventy-five and Zero Hundredths
Feet (N 66° 55' 46" E - 75.00') to a point on the same and a front corner of Lot
No. 78;
THENCE leaving said right-of-way and along the property line of
said Lot 78, South Twenty-three Degrees Four Minutes Fourteen Seconds East a
distance of One Hundred Thirteen and Thirty-Two Hundredths Feet (S 23° 04'
14" E - 113.32') to a point on the same and a corner of Lot 112;
THENCE along property line of said lands, South Seventy-two
Degrees Fourteen Minutes Thirty-Five Seconds West a distance of Seventy-five
and Thirty-two Hundredths Feet (S 72°.14' 35"W - 75.32') to a point on the
same and a corner of Lot No. 80;
THENCE along Lot 80, North Twenty-three degrees Four Minutes
Fourteen Seconds West a distance of One Hundred Six and Thirty-four
Hundredths Feet (N 23° 04' 14"W - 106.34') to a point, said point being the
Point of Beginning.
BEING part of the same premises which Ashcombe Products
Company, a Pennsylvania corporation, by its deed dated October 29, 1998 and
recorded February 13, 1997 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Deed Book 153, Page 279, granted and
conveyed unto Country Square Partnership, a Pennsylvania general partnership,
in fee.
