Walters of 4079 Regiment Blvd., Enola isabouttoexecutecontemporaneously herewith, a contract, with Haubert Homes, INc. of 15 Central Blvd., Camp Hill ~rtheerectionofa story Pennsylvania, Pennsylvania, building upon a lot of land situate upon premises commonly known as 1414 INVERNESS DRIVE, Township HAMPDEN, CUMBERLAND County, Pennsylvania, as set forth in the deed dated , recorded at Deed Book , Page , in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW. August 28, 2003 ~ , at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar. to Contractor paid by Owner . it m agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Tamara S. ~alters EXHIBIT "A" ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point located on the northerly right-of-way line of Inverness Drive, Twenty-five Feet (25') from the centerline of the same and being a front property corner of Lot 16; THENCE along said northerly right-of-way, by a curve to the left having a radius of 175.00 feet an arc distance of 77.20 feet being subtended by a chord of North 87 Degrees 44 Minutes 13 Seconds West (N87°44'13"W) a distance of 76.57 feet to a point; THENCE North 10 Degrees 22 Minutes 28 Seconds West (N10°22'28"W) a distance of 125.00 feet to a point, said point being a corner of Lot 131; THENCE along said Lot 131, South 87 Degrees 44 Minutes 13 Seconds East (S87°44'13"E) a distance of 131.27 feet to a point, said point being a corner of Lot 16; THENCE along said Lot 16, South 14 Degrees 54 Minutes 01 Seconds West (S14°54'01"W) a distance of 125.00 feet to a point on said northerly right-of-way, said point being the POINT OF BEGINNING. BEING all of Lot I7, Phase 4, Fairwinds, as shown on a plan titled "Fairwinds, Final Phase 4", as prepared by Melham Associates PC, dated February 26, 2003
