Home Designs Unlimited, Contractor In the Court of Common Pleas County of Cumberland, Pennsylvania, Number Term, 2003 Whereas, Rohit Sachdeva and Shabnam J. Sachdeva, Owners Of, property known as Lot #122 on the Final Subdivision Plan for Westbury - Phase 6-B, with a property address of 5735 Aspen Lane, Hampden Township Cumberland County, Pennsylvania, Is about to execute contemporaneously herewith, a contract with Unlimited with an address Home Designs Of P.O. Box 387, New Kingstown, PA 17072 Pennsylvania, For the erection of a standard dwelling upon land situate: ALL THAT CERTAIN piece, parcel or lot of land situate in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Eastern right-of-way line of Aspen Lane (50.00 feet wide), said point being located at the Southwestern comer of Lot No. 123; then along the Southern boundary line of Lot No. 123, and along the centefline of a 20.00 foot wide sanitary sewer access easement, South 68 degrees 32 minutes 27 seconds East, for a distance of 152.85 feet, to a point in line of other lands now or formerly of The McNaughton Company; then along lands now or formerly of McNaughton, and through said 20.00 foot wide sanitary sewer easement, and through a proposed variable width drainage easement, and through a proposed 30.00 foot wide storm sewer easement, South 42 degrees 02 minutes 22 seconds West, for a distance of 142.70 feet, to a point at the Southeastern comer of Lot No. 121; then along the Eastern boundary line of Lot No. 121, and through said proposed variable width drainage easement, and along the centerline of said proposed 30.00 foot wide storm sewer easement, North 42 degrees 50 minutes 56 seconds West, for a distance of 133.15 feet, to a point on the Eastern right-of-way line of Aspen Lane (50.00 feet wide); then along said right-of-way line, and through said proposed 30.00 foot wide storm sewer easement, on the arc of a circle curving to the left, having a radius of 175.00 feet, and an arc length of 78.47 feet, and through said 20.00 foot wide sanitary sewer access easement, to a point and the place of BEGINNING. BEING known and numbered as Lot No. 122 on the Final Subdivision Plan for Westbury - Phase 6-B, which is recorded in Cumberland County in Plan Book 83, Page 129. UNDER AND SUBJECT TO: (a) Any and all easements, licenses, exceptions, reservations, covenants, agreements, conveyances and restrictions which affect the premises and are visible by inspection of the premises. (b) Any and all easements,, licenses, exceptions, reservations, covenants, agreements, conveyances and restrictions contained in any and all prior agreements, leases, deeds, grants and conveyances affecting the premises. (c) Plan notes prohibiting the construction of any structure (other than a fence, uncovered steps and entrance canopies - not greater than 3 feet in height and 6 feet in width) within any 50 foot buffer yard shown on the subdivision plan of record. (d) The Declaration of Covenants and Restrictions which is recorded in the Office of the Recorder of Deeds for Cumberiand County in Miscellaneous Book 681, Page 160, as may be applicable to the premises. BEING PART OF THE SAME PREMISES which Jean I. Cignetto, widow, of 32 Bali Hai Road, Mechanicsburg, Cumberland County, Pennsylvania, by deed dated March 21, 1990 and recorded 'in Cumberland County in Book L34, Page 954, conveyed to The McNaughton Company, a Pennsylvania corporation, Grantor herein. Now, ,2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners To the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Home Designs Unlimited and the further consideration of One Dollar, to Contractor paid by Owners. It is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the fight to file such liens being expressly waived.
