COMPLAINT IN DIVORCE
1. Plaintiff is Helen V. Yates, a competent adult individual, who resides at 336 E. Street,
Carlisle, Pa. 17013.
2. Defendant is Jimmy Yates, a competent adult individual, who resided at 336 E. St.
Carlisle, Pa. 17013, until September 12, 2007.
3. Plaintiff and Defendant have been bona fide residents of the Commonwealth for at
least 6 months immediately previous to the filing of this Complaint.
4. The Plaintiff and the Defendant were married on December 13, 2004, in Cumberland
County, Pennsylvania.
5. There have been no prior actions of divorce or for annulment between the parties.
6. Plaintiff has been advised that counseling is available and that plaintiff may have the
right to request that the court require the parties to participate in counseling.
7. Plaintiff and Defendant have no children together.
8. Plaintiff and Defendant are both citizens of the United States of America.
9. Neither Plaintiff or Defendant are a member of the Armed Forces of the United States
of America or any of its allies.
10. The Plaintiff avers that the grounds on which this action is based are: That the
marriage is irretrievably broken.
WHEREFORE, Plaintiff requests the court to enter a decree in divorce.

AND NOW comes, Helen V. Yates, by and through her attorney, Jane Adams,
Esquire, and makes the following Petition for Economic Relief against the respondent,
Jimmy Yates as follows:
COUNT I - EQUITABLE DISTRIBUTION OF PROPERTY
1. Petitioner is Helen V. Yates, who is the Plaintiff in a divorce action filed under
the above-captioned number. Her address is: 336 E. Street, Carlisle, Pa. 17013.
2. Respondent is Jimmy Yates, whose current address is unknown. He is
represented by Karl Rominger, Esquire.
3. The parties were married on December 13, 2004.
4. During the course of the marriage, the parties have acquired numerous items
of property, both real and personal, which are held in joint names and in the individual
names of each of the parties hereto.
5. During the course of the marriage, the parties incurred numerous debts.
6. Plaintiff and Defendant have been unable to agree as to an equitable division
of said marital property and debts.
7. Plaintiff is seeking an equitable division of all marital property.
WHEREFORE, Petitioner prays this Honorable Court, after requiring full
disclosure by the Plaintiff, to equitably divide the property, both real and personal,
owned by the parties hereto as marital property.

MOTION TO WITHDRAW AS COUNSEL
AND NOW, comes Karl E. Rominger, Esquire of Rominger & Associates who files this
Motion to Withdraw, and in support thereof, avers as follows:
1. Undersigned entered his appearance on October 1, 2007 on behalf of the Defendant
for the above divorce matter.
2. Undersigned counsel has had no contact with Defendant since February 11, 2008, and
Defendant has failed to contact undersigned counsel.
3. Undersigned counsel has forwarded a copy of the Notice of Appointment of Master,
on August 4, 2009, the correspondence received from Attorney Adams on October 6,
2009, at Defendants address of 9 North Queen Street, Shippensburg, Pennsylvania
17257, and have not received the mail back as return to sender and Defendant has
failed to contacted undersigned counsel regarding said mailings.
4. Undersigned counsel is unable to prepare the necessary documentation needed by the
Divorce Master without communication from the Defendant.
WHEREFORE, Attorney Karl E. Rominger, Esquire respectfully requests that he be
allowed to withdraw as counsel for the Defendant in the above captioned case.

that time, the party filing the exceptions should
notify the court reporter in the Master's office so
arrangements can be made for a transcript. Upon
completion of the transcript and receipt of payment,

Prothonotary's office for transmittal to the Court at
time of argument on the exceptions.
If no exceptions are filed, counsel shall prepare an
order of Court consistent with the recommendations
and provide a proposed order of Court to the Master.
Counsel shall also prepare and provide with the

In accordance with P.R.C.P. 1920.55 within ten (10) days,

bonds of matrimony.
Any existing spousal support order shall hereafter be deemed an order for
alimony pendente lite if any economic claims remain pending.
The court retains jurisdiction of any claims raised by the parties to this action
for which a final order has not yet been entered. Those claims are as follows: (If no

recommendations, and twenty days have passed since the filing of the report,

hereby DECREED and ORDERED:
1. With respect to the real estate at 336 E. Street, Carlisle, Cumberland County,
Pennsylvania, the interest of Jimmy Yates is extinguished and the seller of said real
estate is directed to provide a deed to Helen Yates only as grantee when a deed is
presented for the purpose of completing the terms of the sales agreement transferring
legal title.
2. Helen V. Yates is entitled to a fee simple ownership solely in the property
when the sales agreement is paid off and the deed is delivered to transfer title to the
payor, Helen V. Yates, under the terms of the agreement.
3. If necessary in the future, Jimmy Yates, if requested, shall sign any and all
documents necessary to release and assign his interest to wife, Helen V. Yates, in the
property at 336 E. Street, Carlisle Cumberland County, Pennsylvania.
4. Should Jimmy Yates not cooperate or his whereabouts become unknown, the
Court can require and direct the Recorder of Deeds of Cumberland County,
Pennsylvania, sign any documents required to transfer fee simple title solely in the
name of Helen V. Yates for the property at 336 E. St., Carlisle, Cumberland County,
Pennsylvania.
