AND NOW comes the Appellant, Stephanie A. Breighner, by and through her attorneys,
the Law Offices of Patrick F. Lauer, Jr., LLC and respectfully avers the following:
I. Appellant resides at 4630 South Clearview Drive, Camp Hill, Cumberland
County, Pennsylvania 17011.
2. The underlying violation that is alleged for this suspension occurred in Lancaster
County.
3. Appellant received a notice dated September 12, 2007, that as a result of her
conviction of violating § 3362 of the Vehicle Code, Exceeding Maximum Speed on
9/04/2007, 4 points have been assigned to her record. Since her point record shows an
accumulation of 13 points, a sanction of 195 days is hereby imposed as mandated by Section
1539 of the Vehicle Code. A copy of the Notice is attached as Exhibit "A."
4. Appellant filed a timely Summary Criminal Conviction Appeal in Lancaster
County Court regarding her conviction on September 4, 2007, and is awaiting a hearing date.
5. Appellant submits that there has not been a final disposition of her appeal and that
she would be unduly prejudiced if the suspension were to be imposed at this time.
6. There was insufficient evidence to convict the Appellant.
7. The Appellant denies she committed the offense.

WHEREFORE, your Appellant respectfully requests your Honorable Court to schedule an
evidentiary hearing on the matter and to reverse the Department's Order to suspend her
Pennsylvania operating privileges.

Dear Motorist:
As a result of your conviction of violating section 3362
of the Vehicle Code EXCEEDING MAXIMUM SPEED on 09/04/2007,
4 points have been assigned to your record.
Your total point accumulation is 13 points.
Since your point record shows an accumulation of 13
points, a sanction of 195 DAY(S) is hereby imposed as
mandated by Section 1539 of the Vehicle Code.
in order to comply with this sanction you are required to
return any current driver's license, learner's permit and/or
temporary driver's license (camera card) in your possession
no later than the effective date listed. If you cannot
comply with the requirements stated above, you are required
to submit a DL16LC Form or a sworn affidavit stating that
you are aware of the sanction against your driving
privilege. Failure to comply with this notice shall result
in this Bureau referring this matter to the Pennsylvania
State Police for prosecution ender SECTION' 1571 (a) (4) of the
Vehicle Code.
Although the law mandates that your driving privilege is
under suspension even if you do not surrender your license,
Credit will not begin until all current driver's license
product(s), the DL16LC Form, or a letter acknowledging your
sanction is received in this Bureau.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR
ACKNOWLEDGEMENT, WE WILL SEND YOU A RECEIPT. IF YOU DO NOT
RECEIVE THIS RECEIPT WITHIN 15 DAYS CONTACT THE DEPARTMENT
IMMEDIATELY. OTHERWISE, YOU WILL NOT BE GIVEN CREDIT TOWARD
SERVING THIS SANCTION.

You will be notified of any outstanding restoration
requirements approximately 30 days before the eligibility
date of the restoration of your driving privilege. You must
follow those instructions very carefully in order to have

Common Pleas (Civil Division) within 30 days of the mail
date, SEPTEMBER 12, 2007, of this letter. If you file an
appeal in the County Court, the Court will give you a
