Steele, Executor of the Estate of Richard G. Steele deceased, Kenneth D. Steele, Trustee of the Debra Mason Special Needs Trust, and Debra Mason, individually, Debra Mason, as Guardian for Michelle Mason, and Angela Brungard, individually, all vested or contingent beneficiaries of Special Needs Trust created by the Last will and Testament of Richard G. Steele dated September 7, 2005, by and through counsel of Andrew C. Sheely, Esquire, hereby file this Joint petition for termination of the Debra Mason Special Needs Trust and beneficial interests created therein in accordance with 20 Pa. C.S.A. S6102 (a), and respectfully state as follows: 1. Petitioner, Kenneth D. Steele, is the son of decedent and Executor of the Estate of Richard G. Steele, having been granted Letters Testamentary on March 23, 2007 by the Register of Wills of Cumberland County, Pennsylvania at the above-captioned docket number. 2. Petitioner, Kenneth D. Steele, is also the named Trustee of the DEBRA MASON SPECIAL NEEDS TRUST created by Item 2 C. of the' Decedent's Last Will and Testament. ~-.', ... , ' . .., '- , G~' .:\ I? ',:-. 3. Petitioner, Debra Mason, age 49, is a surviving natural child of decedent. 4. Petitioner, Debra Mason, is the court appointed guardian for her husband, James Mason, who suffers from a permanent brain injury, and therefore the only adult guardian of Michelle Mason, a named contingent beneficiary of the DEBRA MASON SPECIAL NEEDS TRUST. 5. Petitioner Angela Brungard is an adult individual and the natural daughter of Petitioner Debra Mason. 6. At the time of the decedent's death, the probate Estate of Richard G. Steele consisted of approximately $30,000.00 held in the form of checking and banking accounts titled in the name of the decedent. 7. In addition, the decedent Richard G. Steele was the owner of a non-qualified fixed Annuity held by the Lincoln Benefit Life Company with an approximate date of death value of $50,000.00. 8. Pursuant to the annuity contract, the DEBRA MASON SPECIAL NEEDS TRUST was a named beneficiary of the Lincoln Financial annuity and entitled to approximately one-third (1/3) of the value thereof or approximately $16,667.00. 9. In addition, the decedent Richard G. Steele was the owner of a life insurance policy controlled by CUNA Mutual Life Insurance Company with a death benefit of $75,000.00. 10. Pursuant to the policy of insurance, the DEBRA MASON SPE- CIAL NEEDS TRUST was a named beneficiary of the CUNA Mutual Life 2 Insurance Company and entitled to approximately one-third (1/3) of the death benefit, or approximately $25,000.00. 11. Item 2 C. of the Last Will and Testament of Richard G. Steele, decedent, directed that 1/3 of the Estate of Richard G. Steele, be held, administered and distributed as a separate Trust for extra and supplemental care of Debra Mason during her lifetime, and then distributed to the children of Debra Mason upon the death of Debra Mason. 12. As a result of a 1999 motor vehicle accident which perma- nently injured her husband, Debra Mason is the Court appointed guard- ian of her husband's person and estate. 13. Due to her position as Guardian for her husband which requires full time care and assistance and the amount of limited income available to Debra Mason and her husband, Debra Mason receives certain State health insurance benefits for her care and aid. 14. If created, any payment of funds to Debra Mason directly or indirectly from the DEBRA MASON SPECIAL NEEDS TRUST would cause her to report income available for her and her husband's support which would deprive her of certain benefits which she and her husband receive as a result of his permanent injuries and ongoing medical costs and expenses. 15. Kenneth D. Steele, Trustee of the DEBRA MASON SPECIAL NEEDS TRUST, has advised Petitioner Debra Mason that he does not intend to release funds from the DEBRA MASON SPECIAL NEEDS TRUST to her if such 3 funds would deprive her and her husband of currently available bene- fits from the Commonwealth of Pennsylvania. 16. Decedent's Last Will and Testament specifically stated that no income from the DEBRA MASON SPECIAL NEEDS TRUST should be consid- ered as an available resource of Debra Mason so as to limit her ability to acquire certain Federal, State and local benefits which she may be entitled as a result of a permanent brain injury sustained by her husband with whom she and her daughter Michelle Mason present- ly reside. 17. Funds available for distribution to the DEBRA MASON SPECIAL NEEDS TRUST should not exceed $45,000.00. 18. The creation and establishment of the DEBRA MASON SPECIAL NEEDS TRUST as directed by Item 2 C. of the Decedent's Last Will and Testament would: a. Inflict unnecessary annual accounting costs for trust administration and income tax consequences upon distri- butions therefrom where minimum assets would be distributed from said trust throughout the life of Debra Mason due to her husband's permanent medical condition; and b. Inflict unnecessary practical and liability burdens upon the Trustee who does not wish to administer a trust in light of the testamentary trust limitations and the current value of such trust throughout the life of Debra Mason; and c. Inflict unnecessary costs associated with the employment of experts to assist with performing the fiduciary responsibilities associated with Trust administration throughout the life of Debra Mason; and d. Defeat the specific requests of Debra Mason who consents to the termination of the trust in accordance with the statement attached hereto so as to award said testamenta- 4 ry trust funds to her children and the grandchildren of the decedent; and e. Defeat the specific requests of Angela M. Brungard, a residual beneficiary of said trust, who is at least 24 years of age and capable of managing financial resources in accordance with the statement attached hereto; and f. Defeat the specific requests of Debra Mason, sole guardian of her daughter Michelle Mason, a minor, in light of the stated position herein that one half all funds which would be paid to Debra Mason Special Needs Trust could be held in the name of Michelle Mason pending her majority. 19. Petitioners believe that proceeds from the Lincoln Financial Annuity and the CUNA life insurance policy will be paid to the Estate of Richard D. Steele if the trust is not created as requested in this Petition. 20. All beneficiaries to the Estate of Richard D. Steele have acknowledged consents to the termination of the trust as attached hereto. Copies of the consents are attached hereto as Exhibit UAU. 21. Upon transfer of the funds from the annuity to the Estate, all beneficiaries have consented to the proposal that all proceeds from the Lincoln Financial Annuity and the CUNA life insurance policy in the approximate amount of $38,667.00 available to be paid to the DEBRA MASON SPECIAL NEEDS TRUST should be paid directly to the children of Debra Mason, namely Angela Brungard and Michelle Mason, from the funds so transferred to the Estate. A copy of the consents are attached hereto as Exhibit UAU. 22. Debra Mason intends to file a Disclaimer of her interest 5 in the Estate so as to waive any claim which she may have therein. A copy of the Disclaimer intended to be filed is attached hereto as Exhibit UBU. 23. Angela Brungard has agreed to serve as the custodian of all funds transferred to Michelle Mason as a result of terminating the DEBRA MASON SPECIAL NEEDS TRUST pending Michelle Mason's majority. 24. All beneficiaries to the Estate of Richard D. Steele have acknowledged consents to the payment of the proceeds from Lincoln Financial Annuity and the CUNA life insurance policy to Angela Brungard and to Michelle Mason in accordance with the preceding paragraphs. Copies of the consents are attached hereto as Exhibit UBU. 25. Termination of the DEBRA MASON SPECIAL NEEDS TRUST is not intended to nor will materially prejudice the rights of any creditor of a named beneficiary of the Trust or Estate. 26. Termination of the DEBRA MASON SPECIAL NEEDS TRUST is consistent with Item 2 C. of the Decedent's Last Will and Testa- ment as the decedent specified that the purpose of the Will was to establish no income for Debra Mason individually for the reasons set forth therein. 27. petitioners believe that no adverse inheritance tax consequences will be imposed upon the Estate or deprive the Com- monwealth of Pennsylvania any inheritance tax. 6 28. petitioner, Debra Mason, guardian of Michelle Mason, a non-vested minor beneficiary, consents to termination of DEBRA MASON SPECIAL NEEDS TRUST in accordance with the representations contained herein. WHEREFORE, Petitioners respectfully request that this Honor- able Court enter an Order of Court terminating said Debra Mason Special Needs Trust as established by Item 2 of the Decedent's Last will and Testament, and further direct that any and all proceeds received by the Estate from the Lincoln Financial Annuity and the CUNA life insurance policy shall be directed to Angela Brugard, individually, and to Michelle Mason, a minor, to her custodian, Angela Brungard, until the majority of said Michelle Mason.
