Miller, by and through his attorney, Mark T. Silliker, Esquire, and respectfully requests this Honorable Court award him custody of the subject minor child, and in support thereto, avers the following: 1. Plaintiff is Steven B. Miller, an adult individual residing at 4061 Caissons Court, Enola, Cumberland County, Pennsylvania. 17025. 2. Defendant is Kimberly A. Miller, an adult individual residing at 980 Woodley Drive, Mechanicsburg, Cumberland County, Pennsylvania. 17055. 3. The subject child is Emma S. Miller, born November 11, 1993. 4. The relationship of the Plaintiff to the subject minor child is that of natural father. 5. The relationship of the Defendant to the subject minor child is that of natural mother. 6. The minor child has resided at the following addresses, in the custody of the following individuals: a. From December, 2000 to the present - the subject minor child resides with Defendant at 980 Woodley Drive, Mechanicsburg, Cumberland County, Pennsylvania. b. From 1997 to December, 2000 - the subject minor child resided with Plaintiff and Defendant at 19 Trout Lane, Marysville, Perry County, Pennsylvania. 7. There have been no prior actions for custody of the subject minor child in this or any other jurisdiction. However, the parties have been operating under a Separation Agreement between them which included a custody provision. 8. The Plaintiff is not aware of the existence of any other individuals who have any type of claim whatsoever regarding the custody of the subject minor child. 9. Currently the subject minor child is in the primary physical custody of her Mother, Defendant Kimberly A. Miller. Until recently., Father had enjoyed partial custody rights consisting of two visits per week, as well as every other weekend. 10. Plaintiff he can provide an extremely healthy and otherwise wholesome environment in which to assist in the upbringiug and care of the subject minor child. Therefore, he would respectfully request this Honorable Court award him shared custody or additional periods of partial custody, relative to the subject minor child, Emma S. Miller. Legal Custody. The parties, Steven B. Miller and Kimberly A. Miller, shall have shared legal custody of the minor child, Emma S. Miller, born November 11, 1993. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the child's general well-being including, but not limited to, all decisions regarding her health, education and religion. Pursuant to the terms of Pa. C. S. §5309, each parent shall be entitled to ail records and information pertaining to the child including, but not limited to, medical, dental, religious or school records, the residence address of the child and of the other parent. To the extent one parent has possession of any such records or information, that parent shall be required to share the same, or copies thereof, with the other parent within such reasonable time as to make the records and information of reasonable use to the other parent. 2. Physical Custody. The parties will have parenting time arranged with the child as follows: A. Commencing November 14, 2003, Father shall have custody on alternating weekends from Friday after school until Monday morning when he returns the child to school. 8:00 p.m. Father shall have custody each Wednesday after school until C. On weekends when Mother is in town during the school year, and during the summer if there is a special activity at church, Father will have custody of the child for approximately two and a half (2¼) hours on Sunday morning for the purposes of attending church. NO. 03-5224 CIVIL TERM D. Each parent shall be entitled to six (6) weeks of custody for purposes of vacation throughout the year. The vacation week shall encompass that party's regularly scheduled custodial weekend. The parties shall provide each other with thirty (30) days written notice of their intended vacation plans. In the event of conflicting or overlapping vacation plans, the parent first providing written notice shall have the choice of vacation. E. The parties will share winter and spring school breaks equally. In the event that the break has an odd number of days, Father will be entitled to have custody for the extra day. 3. Holidays. The parties will share the holidays as described in greater detail in the attachment identified as Exhibit "A". 4. In the event either party is unavailable to provide care for the child during his or her period of custody, that party shall first make a reasonable effort to contact the other party to offer the parent the opportunity to provide care for the child before contacting third- party caregivers. 5. Counseling. The child shall participate in counseling with Julia Tilley at Cornerstone Counseling Center. The provision set forth above that was agreed to by Petitioner herein has been a source of constant aggravation to her in that Respondent herein uses every Sunday that is Petitioner's custodial Sunday as an opportunity to harass her and demand that the child be with him that ]morning. 6 o On instances when the child ~as been sick and tired on Petitioner's Sunday, Respondent has insisted that he have this time with the child on Sunday morning. 7 o On some of the occasions when Respondent has taken the child on the Sunday mornings, he has not taken her to church, but instead to other activities. 8 o It is not in the child's best interest to be sent on Sundays when she is sick or tired, particularly given that she has to get up at 5:00 a.m. or 5:30 a.m. on the weekdays. 9 o Respondent's efforts to obtain custody of the child on Sundays when the child is in Petitioner's custody have deteriorated to the point that his tone and demeanor have necessitated Petitioner hanging up the phone besause she is not able to deal with the abusive tone and the insistence that the child be sent when the child is sick or tired. 10. Petitioner wishes to modify the Court Order to delete the provision set forth above that entitles the Respondent to have the child on mother's alternating weekend for church.
