Beam (the "Estate") and Brenda Graver, Charles Graver and Kris Graver now known as Kris Sayers, testamentary heirs of the Estate of Christine L. Beam, WITNESSETH: WHEREAS, Christine L. Beam died February 5, 2007, survived by her daughter, son-in- law and granddaughter, Brenda Graver, Charles Graver and Kris Graver now known as Kris Sayers ;and WHEREAS, Letters Testamentary were granted to Brenda Graver, as Executrix, on March 13, 2007; and WHEREAS, the undersigned, being all of the testamentary heirs of Christine L. Beam, wish to settle the Estate by agreement rather than by a formal accounting; NOW, THEREFORE, in consideration of the mutual covenants of the parties, all parties intending to be legally bound hereby, it is agreed as follows: 1. An accounting of the receipts and expenditures in the Estate is attached hereto. 2. Each of the undersigned has been fully advised of his or her rights pertaining to the filing of an account and they do hereby waive any right that they may have to compel an accounting prior to the distribution of the estate. 3. Each of the undersigned accepts and approves the attached accounting and agrees that this agreement shall have the same force and effect as if a formal accounting had been filed with and confirmed by the Orphans' Court of Cumberland County. 4. Each of the undersigned agrees that distribution shall be in accordance with the attached schedule. 5. We, Brenda Graver, Charles Graver, and Kris Graver, now known as Kris Sayers, and each of us, in consideration of the promise to the others, do hereby agree to refund to the estate, pro-rata, any amount which maybe necessary in the future to discharge any liabilities of the estate of which we may hereafter receive notice. 6. We, Brenda Graver, Charles Graver and Kris Graver now known as Kris Sayers, do hereby release the Executrix of and from any and all claims we may have under the law against the Estate of Christine L. Beam or against Brenda Graver, the Executrix thereof. 7. This agreement may be executed in multiple counterparts, and when so executed, shall be binding upon the parties and their respective heirs, personal representatives, and assigns.
