THIS AGREEMENT made this" day of~t~'~~', 200;
between Sewalt, Inc. of 454 Old York Road, Dillsburg,
Pennsylvania hereinafter referred to as Contractor,

Rusty L. Garner and Joyce M. Garner, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Monroe Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as 886 Eppley Road,
Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH; That the said
Contractor, for an in consideration of the sum of ($1.00)- Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the r-fight
of lien, shall be an independent covenant.

Exhibit A
ALL THAT CERTAIN tract of land situate in the Township of Monroe,
Cumberland County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a surveyors pin on the North side of Eppley Road also known as
Township Road T-568; said surveyors pin being twenty-five (25) feet from the
centerline of the aforementioned Eppley Road also known as Township Road T-568;
thence along Lot #1, formerly lands of Robert L. Eppley, North fifty-two (52)
degrees thirty-seven (37) minutes five (05) seconds West two hundred (200) feet to a
surveyors pin at other lands of the Eppley Estate and about to be conveyed; thence
along the last mentioned lands North thirty-seven (37) degrees twenty-two (22)
minutes fifty-five (55) seconds East one hundred (100) feet to a surveyors pin at
other lands of Robert L. Eppley Estate; thence along lands of Robert L. Eppley
Estate South fifty-two (52) degrees thirty-seven (37) minutes five (05) seconds East
two hundred (200) feet to a surveyors pin on the Northern side of Eppley Road, also
known as Township Road T-568; thence along the Northern side of said
aforementioned roadway South thirty-seven (37) degrees twenty-two (22) minutes
fifty-five (55) seconds West one hundred (100) feet to a surveyors pin set on the
North side of Eppley Road also known as Township Road T-568 and the place of
BEGINNING.
BEING designated as Lot No. 2, in accordance with a survey by Rodney Lee Decker
dated May 28, 1997 and recorded in Plan Book 47, Page 11.7.
