is three (3) percent [72 P.S. 99116 (a) (1.1) (i)).
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
[72 P.S. 99116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an

The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. 99116(a)(1.3)]. A sibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

Death and Survival Claims on Behalf of the Estate of MILDRED L. HOYER, Deceased, it is
hereby ORDERED and DECREED that the Wrongful Death and Survival Claims of the Estate of
MILDRED L. HOYER, Deceased, arising out of the July 22, 2005 motor vehicle collision, may
be settled as follows:
1. Gross settlement in the amount of Five Hundred Thousand Dollars ($500,000.00)
to be distributed as follows:
a. The amount of One Hundred Sixty-Six Thousand, Six Hundred Sixty-Six
Dollars ($166,666.00) payable to Edgar Snyder & Associates, LLC, for
attorneys fees in the amount of Thirty-Three and One-Third Percent (33
1/3%); ,
b. The amount of Eight Thousand Six Hundred Ninety-Three Dollars
($8693.00) payable to Edgar Snyder & Associates, LLC, for reimbursable
costs in this matter;
c. Two Hundred Ninety Two Thousand, One Hundred Seventy-Six Dollars
and Ninety Cents ($292,176.90), which represents Ninety Percent (90%)
of the remaining settlement, to the wrongful death action, to be further
distributed as follows:

1. Two Hundred Ninety Two Thousand, One Hundred Seventy-Six
Dollars and Ninety Cents ($292,176.90) to Tori Coleen Hoyer,
surviving daughter of Mildred L. Hoyer, Deceased, to be placed
into a structured settlement as described below;
d. Thirty Two Thousand, Four Hundred Sixty-Four Dollars and Ten Cents
($32,464.10), which represents Ten Percent (10%) of the remaining
settlement, to the survival action, to be further distributed as follows:
1. Three Thousand Dollars ($3000.00) payable to Balogh Becker,
Ltd., as full and final settlement of the claim made by Citibank
against the Estate of Mildred L. Hoyer, Deceased;
11. Four Hundred Eighty-Nine Dollars ($489.00) payable to the
Cumberland County Register of Wills for estate taxes; and,
111. Twenty-Eight Thousand, Nine Hundred Seventy-Five Dollars and
Ten Cents ($28,975.10) to Tori Coleen Hoyer, surviving daughter
of Mildred L. Hoyer, Deceased, to be placed into a structured
settlement as described below.
e. Tori Coleen Hoyer, surviving minor daughter of Decedent, will receive a
total of Three Hundred Twenty-One Thousand, One Hundred Fifty-Two
Dollars ($321,152.00) as a result of the settlement of this matter, to be
placed in a structured settlement annuity offered through John Hancock
Life Insurance Company, with a present value of Three Hundred Twenty-
One Thousand, One Hundred Fifty-Two Dollars ($321,152.00), a
guaranteed payout of One Million, Four Hundred Sixty-One Thousand,
Two Hundred Sixty-Eight Dollars ($1,461,268.00), and a total potential
projected payout of Two Million, Five Hundred Twelve Thousand, One
Hundred Thirty-Eight Dollars ($2,512,138.00), payable to Tori Coleen
Hoyer as follows:
1.
Beginning on January 1, 2019, when Tori reaches the age of
twenty-five (25), One Thousand Two Hundred Forty-Three Dollars
and Forty-Three Cents ($1243.43) for life, payable monthly
guaranteed for forty (40) years, increasing at a rate of 2.00%
compounded annually, with the last guaranteed payment on
December 1,2058;

On January 1, 2012, when Tori reaches the age of eighteen (18), a
guaranteed lump sum payment of Twenty Thousand Dollars
($20,000.00);

111. On January 1,2015, when Tori reaches the age of twenty-one (21),
a guaranteed lump sum payment of Twenty Thousand Dollars
($20,000.00);
IV. On January 1,2019, when Tori reaches the age of twenty-five (25),
a guaranteed lump sum payment of Thirty Thousand Dollars
($30,000.00);
v. On January 1, 2024, when Tori reaches the age of thirty (30), a
guaranteed lump sum payment of Forty Thousand Dollars
($40,000.00);
VI. On January 1, 2029, when Tori reaches the age of thirty-five (35),
a guaranteed lump sum payment of Fifty Thousand Dollars
($50,000.00);
VII. On January 1, 2034, when Tori reaches the age of forty (40), a
guaranteed lump sum payment of Sixty Thousand Dollars
($60,000.00);
VIII. On January 1 2039, when Tori reaches the age of forty-five (45), a
guaranteed lump sum payment of Seventy Thousand Dollars
($70,000.00);
IX. On January 1, 2044, when Tori reaches the age of fifty (50), a
guaranteed lump sum payment of Eighty Thousand Dollars
($80,000.00);
x. On January I, 2049, when Tori reaches the age of fifty-five (55), a
guaranteed lump sum payment of Ninety Thousand Dollars
($90,000.00); and,
Xl. On January I, 2054, when Tori reaches the age of sixty (60), a
guaranteed lump sum payment of One Hundred Thousand Dollars
($100,000.00).
f. The annuity contract in question provides for an Internal Rate of Return
(IRR) of 5.78% for which the taxable equivalent yield is 8.03% and shall
not be transferred or assigned to another company without prior approval
of the Orphans' Court Division of this Honorable Court.
2. It is further ordered that Plaintiff-Petitioner, KIMBERLY L. HARPER, as
Administratrix of the EST ATE OF MILDRED L. HOYER, Deceased, is authorized to execute
any necessary documents on behalf of the ESTATE OF MILDRED L. HOYER, Deceased, to
