CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE
And now comes M&T Bank, by its attorneys, Zucker, Goldberg & Ackerman, LLC,
and files this Complaint in Mortgage Foreclosure as follows:
1. The Plaintiff, M&T Bank, which has its principal place of business at 1
FOUNTAIN PLAZA, 7TH FLOOR- P.O. BOX 840, BUFFALO, NY 14203-1495.
2. The Defendants, Frederick M. Eshleman, Jr. a/k/a Frederick Mark Eshleman,
Jr. and Becky S. Eshleman, are individuals whose last known address is 307 East Marble
Street, Mechanicsburg, PA 17055.
3. On or about October 7, 1998, Frederick M. Eshleman, Jr. and Becky S.
Eshleman executed a Note in favor of Keystone Financial Mortgage in the original principal
amount of $128,000.00.
4. On or about October 7, 1998, as security for payment of the aforesaid Note,
Frederick M. Eshleman, Jr. and Becky S. Eshleman made, executed and delivered to Keystone
Financial Mortgage a Mortgage in the original principal amount of $128,000.00 on the
premises hereinafter described, with said Mortgage being recorded in the Office of the
Recorder of Deeds of Cumberland County on October 13, 1998, in Mortgage Book Volume
1489, Page 36. A true and correct copy of said Mortgage containing a description of the

premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part
hereof.
Keystone Financial Mortgage was acquired by M&T Mortgage Corporation on
10/07/2000.
6. M&T Bank is successor by merger to M&T Mortgage Corporation.
7. Defendants are record and real owners of the aforesaid mortgaged premises.
Defendants are in default under the terms of the aforesaid Mortgage and Note
for, inter alia, failure to pay the monthly installments of principal and interest when due.
9. On or about July 9, 2007, Defendant(s) were mailed a combined Notice of
Homeowners' Emergency Mortgage Assistance Act of 1983 and Notice of Intention to
Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance
Act, Act 91 of 1983 and Act 6 of 1974, 41 P.S. §101, et seq.
10. The amount due and owing Plaintiff by Defendants is as follows:

WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount
due of $122,586.29, with interest thereon at the rate of $23.86 per diem from September 5,
2007, plus additional late charges, and costs (including additional escrow advances),
additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.

following Affidavit regarding the service of Plaintiff's Notice of Sheriff's Sale of Real Property
in this matter on Defendant/Owner and Other Parties of Interest as follows:
Defendants, Frederick Mark Eshleman Jr. and Becky S. Eshleman, husband and
wife, are the record owners of the real property.
2. On or about 4/14/08, Frederick Mark Eshleman Jr. was served with Plaintiffs
Notice of Sheriff s Sale of Real Property Pursuant to Pa. R.C.P. 3129, personally by the Sheriff
of Cumberland County, at 307 East Marble Street, Mechanicsburg, PA 17055. A true and
correct copy of said Notice and Return of Service are marked Exhibit "A", attached hereto and
made a part hereof.
3. On or about 4/14/08, Becky S. Eshleman, was served with Plaintiffs Notice of
Sheriff s Sale of Real Property Pursuant to Pa. R.C.P. 3129, personally by the Sheriff of
Zucker, Goldberg & Ackerman, LLC

Cumberland County, at 1077 Nanroc Drive, Mechanicsburg, PA 17055. A true and correct
copy of said Notice and Return of Service are marked Exhibit "B", attached hereto and made a
part hereof.
4. On or about 5/12/08, Plaintiff's counsel served all other parties in interest with
Plaintiff's Notice of Sheriff's Sale according to Plaintiff s Affidavit Pursuant to rule 3129. 1, via
First Class U.S. Mail, Postage Pre-Paid, with a Certificate of Mailing. True and correct copies of
said Notices and Certificates of Mailing are marked Exhibit "C", attached hereto and made a part
hereof.
Finally, the undersigned deposes and says that the Defendants/Owners and all other
Parties of Interest were served with Plaintiff s Notice of Sheriff's Sale of Real Property in
accordance with Pa.R.C.P. 3129.2.

extended, said point being one hud-
nred seventy-five (175) feet measured
along the northern side of East
Marble Street extended in an easterly
direction from the northeast corner of

Lower Sheperdstown Road; thence
