4. Describe in detail any questions requiring adjudication and state the position of the
Petitioner(s) as to each question:
First: Angie Calloway advised me she placed some of her own personal items
inside the mobile home for Ms. Stager to use, she asked how she will regain
possession of those items. The Petitioner has no knowledge as to who owns
these items, however, from what the Petitioner observed on the one visit to the
mobile home, there is very little resale value in the few items. Petitioner holds no
position on this question.
Second: The question is the value of the mobile home vs the removal costs, please
refer to Attachment "C" . In the Petitioners opinion and from past experience it
appears to be of more value to accept the offer from the Manager of the Rolo
Court. The Petitioner's position is to make distribution to Rolo Court.

5. Written Notice of the Audit as required by Pa. O.c. Rules 6.3, 6.7 and 6.8 has been or will be
given to all parties in interest listed in item 6 below. In addition, notice of any questions
requiring adjudication as discussed in item 4 above has been or will be given to all
persons affected thereby.

At issue in the present case is whether Cynthia N.
Stager should be adjudicated an incapacitated person ,on a
..
permanent basis, and, if so, whether the ~rea Agency on
Aging in and for, Cumberland County, Pennsylvania, should.be
appointed plenary guardian of' her person and whether
. Keystone Guardianship Services of Millersburg, Pennsylvania,
and Harrisburg, Pennsylvania, should be appointed plenary
guardian of her estate. A hearing was held in this matter'
on June 28, 2007. 'The allegedly incapacitated person. was
not present for the hearing, her presence having been
excused by the ,Court pursuant to medical testimony and"
without objection on the part of her court-appointed
counsel, Michael J.. Collins, Esquire, who was present.
Based upon the evidence presented at the hearing,
the following Findings of Fact, Di~cussion and Order of
Court are made and entered:

FINDmGS OF FACT
'1. The allegedly' incapacitated person is Cynthia
N. Stager, an adult individual and domiciliary of Cumberland
County, Pennsylvania, who has a borne at 2535 Rolo Court,
Mechanicsburg,Cumberland County, Pennsylvania.
2. Petitioner is the Area Agency on ,Aging in and
for Cumberland County, Pennsylvania, which has offices, at
16 West High Street, Carlisle, Cumberland County,
Pennsylvania.
3. The allegedly incapacitated person is
presently a resident at the ManorcareNursing Horne,
'940 Walnut' Bottom Road, Carlisle, Cumberland, County, .'
Pe'nnsyl vania.
4. The ~llegedly incapacitated person suffers
from a condition known medically as delirium, possibly as
the result'of dementia, as well as from a number 'or other
medical conditions.
5. As a consequence of her condition, the
allegedly incapacitated person's ability to receive and
evaluate information effectively and communicate decisions
is impai'red to such a significant extent that she is totally
,unable to' manage her financial resources, and totally unable
to meet essential requirements for her physical health: and
safety. ,

person's estate is between $30,000 and $150,000.
7. The.prognosis for the allegedly incapacitated
person .at this time is not favorable.
8. The allegedly incapacitated person is in need
of a plenary guardian of her person' and estate.
"9.' The duration of the necessary guardianships'
must be considered at best indefinite, and, for practical .
purposes, permanent.
10. The Petitioner, the Area Agency on Aging in
and for Cumberland County, Pennsylvania, which has offices
. .
at 16 West High. Street, Carlisle, Cumberland County,
Pennsylvania~ is an appropriate entity to serve as. guardian
of the allegedly ~ncapacitated person's person 'and Keystone
Guardiariship Services, having offices at 129 Market Street,
Suite 1, Millersburg, . Pennsylvania, 17061; and 2941 North
Front Street, Suite 112, Harrisburg, Pennsylvania, 17110, is'
an appropriate entity to serve as guardian of her estate.
11. The foregoing Findings of Fact are made on
the basis. of clear and convincing evidence.
DISCOSSl:ON
The provisions respecting an .adjudication of
incapacity are contained in 20.Pa. C.S. Sections 5570
et. seq. The Petitioner has substantially complied with
these provisions, .and based upon the foreg~ing Findings of
Fact, the following Order of Court will be entered:

Plenary Guardian of the Person and Estate Pursuant to

allegedly incapacitated person, and following a hearing, at
which the allegedly incapacitated person was not present
(her presence having been excused by the Court), and at
which she was represented by court-appointed counsel,

Here is the information you had requested regarding Cynthia's family. I spoke with all of them prior to the
guardianship hearings except for Cynthia's mother as she resides in a dementia unit and her POA requested I
not call. The family had no contact with Cynthia in 30 years. Cynthia's ashes and her companion's ashes Robert
were buried together in Cynthia's hometown by the family. If you have any other questions let me know. Have

Connie,
Per our conversation this morning regarding the mobile home belonging to Cynthia Stager: The home
is located at 2535 Rolo Court, within our mobile home park. It is very old (1974 Buddy) and as you
stated, in very bad condition. It is worth nothing due to it's age and condition. Financing is not even
available for homes that old. ..
Rental arrears are currently $1580.00 through September. I'm sure there must be unpaid taxes on the
home as well. Due to the age and condition of the home, the unpaid lot rent and taxes, and the fact
that Cynthia has no will or assets from which to payoff the rental arrears and the rent going forward
($310.00 per month) , I am requesting the home be torn down or removed from Rolo Court as quickly
as possible. The cost to tear down is approximately $1800.00. At your request I will give you the name
and phone number of the individual that we use for tear down. That being said, I know there is no
money to pay for a tear down so I would offer to tear it down at our cost if we can get a release or
permission from the estate.
Please have someone contact me regarding the removal of the home and/or writing up a release.
