NEIDLINGER of 595 Greason Road, Carlisle, PA 17013, hereinafter referred as Contractor, AND RALPH L. DEITCH and LINDA K. DEITCH, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Monroe Township, Cumberland County, Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 1214-1218 Brandt Road, Mechanicsburg, PA 17055. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or ~ny of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. ALL THAT CERTAIN tract of land situate in Monroe Township, Cumberland County, Pennsylvania, and being more particularly bounded and described as follows: BEGINNING at a point in the centerline of Brandt Road (T-557) at the corner of lands now or formerly owned by Ronald Griffith; thence by the same north 02 degrees 03 minutes 00 seconds East 603.68 feet to an iron pin set; thence along the same, North 79 degrees 07 minutes 58 seconds West 725.19 feet to an iron pin set at the corner pf lands of Ronald Griffith and the rear lot line of Lot No. 27 of the Kolb Country Estates Subdivision; thence along the latter North 02 degrees 03 minutes 00 seconds East 156.98 feet to an iron pin set at the northeast corner of Lot No. 27 of the Kolb Country Estates Subdivision and the corner of lands now or formerly owned by Paul M. Simmons and Gladys M. Simmons, his wife; thence along the latter North 01 degree 15 minutes 00 seconds West 366.30 feet to a point; thence along other lands now or formerly of Melvin Kolb and Alma J. Kolb, his wife, and now or formerly of Monroe Township, North 86 degrees 15 minutes 00 seconds East 1150.05 feet to al point; thence along the latter North 18 degrees 00 minutes 00 seconds West 452.10 feet to a point at the corner of lands now or formerly of Monroe Township and lands now or formerly of Duane A. Nicholson and Jean Ann Nicholson, his wife; thence along the latter North 69 degrees 30 minutes 00 seconds East 486.75 feet to a point at the corner of lands of Duane A. Nicholson and Jean Ann Nicholson, his wife, and lands now or formerly of Paul E. Effer et ux; thence along the latter South 18 degrees 00 minutes 00 seconds East 1085,70 feet to a point at the corner of lands now or formerly of Paul E. Peffer et ux and lands now or formerly of Emmit Brandt; thence along the latter Sou~h 69 degrees 30 minutes 00 seconds West 486.75 feet to a point; thence continuing aiong Brandt South 18 degrees 00 minutes 00 seconds East 856.35 feet to a point in the centerline of Brandt Road (T-557); thence following the centerline of the aforesaid road the following two courses South 75 degrees 30 minutes 00 seconds West 165.00 feet; North 81 degrees 15 minutes 00 seconds West 761.31 feet to the place of BEGINNING.
