STIPULATION AGAINST
THIS AGREEMENT made this ~ ~ day
between FCM Builders, INC., a
hereinafter referred to as Contractor,
LIENS
of October, 2007, by and
Pennsylvania Corporation,
AND
William A. Shine and Frances A. Shine, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #28 High Meadow
Phase V, 3416 Canyon Creek, Mechanicsburg, Lower Allen Township,
Cumberland County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further .consideration .mentioned in the
agreement aforesaid, for itself, himself or themse=lves and its, his
or their subcontractors, and all parties acting through or undea~
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

On this, the jJ day of October, 2007, before me, a Notary Public, the
undersigned officer, personally appeared Frederick C. Miller, who acknowledged
himself to be the President of FCM Builders, Inc. and that he as such President
being authorized to do so, executed the foregoing instrument for the purposes
therein contained by signing the name of the said Corporation by himself as such
President.

ALL THAT CERTAIN tract or parcel of land situate in the Township of Lower
Allen, Cumberland County, Pennsylvania; said premises being known as Lot No. 28
as shown on the Final Subdivision Plan for High Meadow Phase V and Phase IV,
Lot 16, dated May 19, 2003 and last revised July 17, 2003 and recorded October 17,
2003, in the Cumberland County Recorder of Deeds Office in Plan Book 88, Page 9,
and said premises being further bounded and described as follows:
BEGINNING AT A POINT on the Southern line of Canyon Creek, said point being
the Northeast corner of Lot No. 28 and labeled as Point of Beginning on the attached
Plat; thence along the Western property line of Lot No. 29 South O1 degrees 57
minutes 48 seconds East, a distance of 35.00 feet to a point; thence along said
Western property line of Lot No. 29, South 04 degrees 25 minutes 17 seconds Fast, a
distance of 117.10 feet to a point; thence along the Northern property line of Lot
"A" North 89 degrees 35 minutes OS seconds West, a distance of 111.83 feet to a
point; thence along the Eastern property line of Lot No. 27 North O1 degrees 45
minutes 57 seconds East, a distance of 142.99 feet to a point on the Southern line of
Canyon Creek; thence along the Southern line of Canyon Creek along a curve to
the left having the radius of 415.11 feet and the length of 92.22 feet to a point, the
Point of BEGINNING.
