BERKHE/MER and R/CH VALLEY CONSTRUCT/ON, LLC, of Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract with R/CH VALLEY CONSTRUCTION, LLC, of Cumberland County, Pennsylvania, for the erection of a building upon a lot of land situate, lying and being in Middlesex Township, Cumberland County, Pennsylvania, bounded and limited in accordance with Exhibit 'A "attached hereto; NOW, THEREFORE, on October 11, 2007, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One (~ 1.00J Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the building and/or land by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the election of said building, the right to file such liens being expressly waived. Hinson, Member ALL THAT CERTAIN tract of land situate in Middlesex Township, Cumberland County, Pennsylvania, consisting of Lot 5 and Lot 5A on the Plan of Anthony and Davadine S. Lepore, which Plan is recorded in Plan Book 69, Page 10, and more particularly bounded and described as fol%ws, to wit: BEGINNING at an iron pin located in the legal right-of way of Country Club Road and at or near the intersection with Oak Lane, South 58 degrees 00 minutes 00 seconds West, a distance of 140.00 feet; thence along the dividing line between Lot No. 5 and Lot No, lA, North 57 degrees 11 minutes 30 seconds West, a distance of 30.26 feet; thence along the dividing line between Lot No. 5A and Lot No. 1, North 57 degrees 11 minutes 30 seconds West, a distance of 101.24 feet; thence along the dividing line between Lot No. 5A and Lot No. 6A, North 63 degrees 00 minutes 30 seconds East, a distance of 33.95 feet to an iron pin to a point; thence along the dividing line between Lot No. 5 and Lot No. 6, North 63 degrees 00 minutes 30 seconds East, a distance of 183.43 feet to an iron pin; thence along the legal right-of way of Oak Lane, South 32 degrees 55 minutes 30 seconds East, a distance of 87.80 feet to a point; thence by a curve to the right having a radius of 12 feet, and an arc length of 19.04 feet to a point, the place of BEGINNING. UNDER AND SUBJECT to the restrictions as set forth in the P/an of Evergreen Estates, Section "A'; and to restrictions placed on said lots by D. Edward Ott, dated December 27, 1956, and recorded in Misc. Book 124, Page 351, Cumberland County records, and to those on the Plan.
