John H. Broujos, Esquire respectfully represents the following in support of this Motion: This is an estate which was fraught with a number of problems and never had closure or Family Settlement because of the death of the executor and the lack of activity by the substitute administrator. Daniel Horner the Executor was unavailable on many occasions during the course of administration. He traveled a lot and had medical and alcohol problems. He was a colonel in the National Guard and took over attempted administration of the estate by improperly preparing a deed of decedent's property transferred to himself, without compliance with estate administration and which was improperly drafted, signed and recorded. Daniel E. Horner refused counsel from me on estate matters and died in June, 2001, subject to numerous complications. 2. Letters Testamentary were then granted to a substitute Executor Randal J. Horner, who lived in Philadelphia and who was unable to locate relevant documents in the East Street, Carlisle house, which was in shambles. Randal Horner was then executor, who was uncooperative and probably gave up on getting his calls returned. Waypoint Bank foreclosed on the house and apparently title is in Waypoint. The estate was insolvent. ~\ 4. This is a no asset case as well as a no asset case in the Daniel Horner estate, represented by attorney James Flower, Jr., who apparently also was unable to find a buyer for sale of the home. 5. This is the status report. WHEREFORE, Petitioner prays Your Honorable Court to grant John H. Broujos, Esquire leave to withdraw as counsel in the above captioned estate.
