NO LIEN AGREEMENT
WHEREAS, an agreement was entered into between MINNICH`S
CUSTOM HOMES, of 95 Fox Lane, Newville, PA 17241, "CONTRACTOR", and
LARRY 7.OSIECKI AND CARLA M. OSIECKI, of 197 Moose Hill Road,
Oxford, CT 06478, ~~OWNER". Whereby the said contractor undertook and
agreed to perform certain work necessary to erect a building on the real estate
of the owners situate at 144 ROXBURY ROAD, LOWER MIFFLIN
TOWNSHIP, CUMBERLAND COUNTY, PENNSYLVANIA.
That the said Contractor, for and in consideration of the sum of One ($1.00)
Dollar in hand paid to it by Owner, the receipt whereof is hereby acknowledged,
and the further consideration mentioned in the agreement aforesaid, for itself
and its subcontractors, and all parties acting through or under it or them,
covenant and agree that no mechanic's liens or claims shall be filed or
maintained by it or any of them against the said improvements and the lot of
ground appurtenant thereto for ar on account of any work done or materials
furnished by it or any of them under said contract or otherwise, for, towards, in
or about the erected and construction of the said improvements on the lot above
described, and the said Contractor, for itself, its subcontractors and others under
it hereby expressly waives and relinquishes the right to have, file, and maintain
any mechanic's liens or claims against the said buildings or any of the
improvements, and agrees that this instrument, waiving the right of lien, shall be
an independent covenant.

ALL THAT CERTAIN tract of land situate in Lower Mifflin Township, Cumberland
County, Pennsylvania, bounded and described as follows:
BEGINNING at a point located along a public right-of--way known as Roxbury Road (S.
R. 0997); thence along a private lane named as Short Lane; thence along Short Lane, the
following 5 calls: 1) South 66 degrees 58 minutes 41 seconds East, 829.17 feet to an
existing iron pin; 2) South 65 degrees 53 minutes 43 seconds East, 95.92 feet to an
existing pin; 3) South 59 degrees 46 minutes 40 seconds East, 88.42 feet to a point; 4)
South 57 degrees 36 minutes 49 seconds East, 328.21 feet to an existing iron pin; and 5)
South 66 degrees 29 minutes 10 seconds East, 40.92 feet to an existing pin at lands now
or formerly of Joseph R. Ross, Jr.; thence along said lands, North 40 degrees 51 minutes
37 seconds East, 449.48 feet to an existing iron pin; thence continuing along same, South
47 degrees 13 minutes 00 seconds East, 235.27 feet to an existing iron pin at lands now
or formerly of Realand, Inc.; thence along said lands, North 26 degrees 33 minutes OS
seconds East, 678.90 feet to an existing pin at lands now or formerly of Ray L. Dehil;
thence along said lands, North 56 degrees 33 minutes 57 seconds West, 1,420.47 feet to
set iron pin at lands now or formerly of John D. Kerstetter (Lot #2 of the hereinafter
mentioned Plan); thence along said lands, South 23 degrees 21 minutes 34 seconds West.
232.81 feet to set iron pin; thence along same, North 56 degrees 33 minutes 57 seconds
West, 380.06 feet to a set iron pin; thence continuing along same, North 56 degrees 33
minutes 57 seconds West, 25.42 feet to a railroad spike located along the centerline of
Roxbury Road (S. R. 0997); thence along Roxbury Road (S. R. 0997), South 23 degrees
21 minutes 34 seconds West, 1,001.51 feet to a point and place of BEGINNING.
CONTAINNING 41.4036 acres and being described as Lot No. 1, according to a
Subdivision Plan for Roy & Dorothy L. Hall, and Beth Hall, by Eric L. Deffenbaugh,
P.L. S., dated March 16, 2004, and recorded in Cumberland County Plan Book 89, Page
51.
BEING the same premises which Joshua W. Jones, single man, by deed dated June 8,
2007 and recorded June 11, 2007, in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Record Book 280, Page 2103, granted and
conveyed unto Larry J. Osiecki and Carla M. Osiecki, husband and wife.
