For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 3% [72 P.S. 99116
(a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. 99116 (a) (1.1) (ii)]. The
statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax retum are still applicable even if the surviving
spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent, or a
stepparent of the child is 0% [72 P.S. 99116(a) (1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. 99116(1.2) [72 P.S. 99116(a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. 99116(a)(1.3)]. A sibling is defined, under Section 9102, as an individuai
who has at least one parent in common with the decedent, whether by blood or adoption.

this Will are to her. I have three children: Suzanne S. Wells (born Novem~r 22, c;.;:'

1951); Marianne S. Bartlett (born August 27, 1954); and Carolyn S. Diercksen (bof-n
November 17, 1956). They are described in this Will as "my children," or as "a child of
mine." Any person born to or adopted by a child of mine is described in this Will as "my

decree of adoption is entered before such adopted person attains the age of twenty-
one (21) years.
SECOND: I give my tangible personal property and all casualty insurance that I
am carrying on said tangible personal property to my wife. In the event my wife fails to
survive me, then I give said tangible personal property to such of my children who are
living at my death to be divided equally among or between them as they may
determine, or, if they are unable to agree, as my Executor shall determine, after
considering the wishes of such children. Any such property not so distributed shall be
sold, and the proceeds added to my residuary estate to pass as hereafter described.
FOURTH: In the event my wife shall survive me, I give, devise and bequeath
the rest, residue and remainder of my estate, real and personal, to my wife. If my wife
fails to survive me, I give, devise and bequeath such rest, residue and remainder of my
estate in equal shares to each of my children, Suzanne S. Wells, Marianne S. Bartlett
and Carolyn S. Diercksen, or their issue per stirpes, or the survivor of them, or their
issue, per stirpes.
FIFTH: If any share hereunder becomes distributable to a beneficiary who has
not attained the age of twenty-five (25) years, then such share shall immediately vest

in such beneficiary, but notwithstanding the provision herein, my Trustee shall retain
possession of such share in trust for such beneficiary until such beneficiary attains the
age of twenty-five (25) years, using so much of the net income and principal of such
share as my Trustee deems necessary to provide for the proper medical care,
education, support and maintenance in reasonable comfort of such beneficiary, taking
into consideration to the extent my Trustee deems advisable any other income or
resources of such beneficiary or his or her parents known to my Trustee. Any income
not so paid or applied shall be accumulated and added to principal. Such beneficiary's
share shall be paid over and distributed to such beneficiary upon attaining the age of
twenty-five (25) years, or, if he or she shall sooner die, to his or her executors or
administrators. My Trustee shall have with respect to eacbshareso retained all of the
powers and discretions had with respect to the trusts created herein generally.
SIXTH: If any beneficiary and I should die under such circumstances as would
render it doubtful whether the beneficiary or I died first, then it shall be conclusively
presumed for the purposes of this my Will that the beneficiary predeceased me;
provided, however, that if my wife shall die with me as aforesaid, I direct that my wife
shall be conclusively presumed to have survived me.
SEVENTH: (1) I name my wife, Mary Jane L. Setzer, to be my Executrix,
herein referred to as my Executor, regardless of number or gender. In the event, my
wife is unable or unwilling to serve, I name my daughter Marianne S. Bartlett and my
son-in-law, Alan B. Wells, or the survivor of them, to be my Co-Executors. I direct that
my Executrix or Co-Executors, and their successors, regardless of number or gender,
serve without bond in any jurisdiction in which called upon to act.
(2) I name my daughter, Marianne S. Bartlett, and my son-in-law, Alan
B. Wells, or the survivor of them, to be my Co-Trustees. I direct that my Trustee or Co-
Trustees, and their successors, regardless of number or gender, serve without bond in
any jurisdiction in which called upon to act.

(3) For services as Executor and Trustee, my Executor and Trustee
shall receive reasonable compensation.
EIGHTH: (1) I give to any Executor and to any Trustee named in this Will or
any Codicil hereto or to any successor or substitute Executor or Trustee all of the
powers enumerated in this Will and all of the powers applicable by law to fiduciaries in
the Commonwealth of Pennsylvania and in particular through the Pennsylvania
Probate, Estates and Fiduciaries Code, as effective and as in effect on the date of my
death, during the administration and until the completion of the distribution of my
estate, and until the termination of all trusts created in this Will or any Codicil hereto
and until the completion of the distribution of the assets of such trusts. I direct that all
SUCR powers shall be cGF'lstruedin the gmadestpossible manner and shall beexer-

cisable without court authorization.
(2) My Executor and my Trustee are authorized and empowered to
disclaim any interest, in whole or in part, of which I, my Executor, or my Trustee, may
be the beneficiary, devisee, or legatee, by executing an appropriate instrument (in
accordance with section 2518 of the Internal Revenue Code of 1986, as amended, or
such similar section as may then be in effect).
NINTH: No person who at any time is acting as a Co.-Trustee (if any) hereunder
shall have any power or obligation to participate in or to exercise any discretionary
authority that I have given to my Trustee to pay principal or income to such person, or
for his or her benefit or in relief of his or her legal obligations. Such discretionary
authority shall be exercised solely by the disinterested co-trustee.
TENTH: No interest of any beneficiary under this Will, any Codicil hereto, or
any trust created herein, shall be subject to anticipation or to voluntary or involuntary
alienation.
ELEVENTH: All estate, inheritance, succession and other death taxes imposed
or payable by reason of my death and interest and penalties thereon with respect to all

property comprising my gross estate for death tax purposes, whether or not such
property passes under this Will, shall be paid out of the residue of my estate, as if such
taxes were expenses of administration, without apportionment or right of reimburse-
ment, except as otherwise might be determined by my Executor in its sole discretion.

BEGINNING at a point, said point being the intersection of the southern right of
way line of West High Street and the eastern rlghl of way line of Parker Street; thence in an
easterly direction along the southern right of way line of West High Street a distance of 120
feet to a point on a drive alley; ~ence along the western right of way line of said drive alley
a distance of 65 feet to a point; thence in a westerly direction a distance of 120 feet to a
point on the eastern right of way line of Parker Street; thence along the eastern right of way
line of Patker Street, a distance of 6S feet to a point on the southern right of way liue of
West High Street) the place of BEGINNING.
HAVING THEREON ERECTED a conunercial building known and numbered as
530 W. High Street, Carlisle, Pennsylvania..
TOGETIIER with all the Mortgagors right, title and interest now owned or hereafter
acquired in: (1) all present and futUre buildings, improvements, ways, water rights~ liberties,
privileges, hereditaments and appurtenances thereunto belonging; (2) all fixtures,

ALL of the above-mentioned real estatet buildings, improvements, ways, water
rights, b'berties, privileges, hereditamentB, appurtenances, machinery. equipnumt:,
appliances, fixtures and personal property are hereinafter collectively refmed to herein as
the mortgaged premises. .
TO HA VB AND TO HOLD the same unto the Mortgagee, its successors and
assigns, forever.
PItOVIDBD, HOWEVER. that if the Mortgagors ma.1l pay to the Mortgagee th~
above sum and all other sums payable by the MOJlgagors to the Mortgagee under the tcms
of the Mortgaee Note, hereby incoIpOrated in this Mortgage Indenture by reference thereto,
.. and shall keep and perform each of the other covenants and agreements hereinafter and in
the Mortgage Note set forth, then this Mortgage Indenture and the real estate hereby granted
and conveyed shall become void and the Mortgagee shall cause this Mortgage Indenture to
be satisfied upon the records of the Recorder ofDceds where if is recorded.
The Mortgagors covenant and agree that:
(1) The Mortgage Note secured hereby shall evidence and this Mortgage Indenture
shall be security for the obligation of the Mortgagors to pay the above sum to the mortgagee
in accordance with the tenm of the Mortgage Note and any sums paid by the Mortp~ee
pursuant to the terms of this Mortgage Indenture, aU of which together is hereinafter called
the debt.
(2) The Mortgagoni, at the Mortgagors' expense, shall keep the mortgage premises
insured against fire and such other risks and casualties in an amount at least equal to the
mortgage with loss payable to the Mortgagee.
(3) The Mortgagors shall pay punctually all taxes, assessments, sewer and water
rents, and all other charges and claims assessed or levied on the mortgaged premises from

time to time by any lawful authority; all ground rents; all mechanics' liens; all debts, liens or
charges which might have priority or parity in lien or payment to the debt secured hereby;
any documcmtary stamps or other tax, including interest and penalties thereon now or
hereafter becoming payable on the Mortgage Note or any other document evidencing Ot
securing the debt of the Mortgagors to the Mortgagee; and premiums and charges on such
policies of fire, hazard and liability insurance with respect to the mortgaged premises as the
Mortgagee reasonably may require from time to time,
(4) The Mortgagors shall perform all of their obligations under any agreement with
the Mortgagee to improve the mortgaged premises and sh811 maintain theriJortgaged
premises and the improvements thereon in good repair.
(5) lfthe Mortgagors fail to make the payments required at (3) above or fails to
maintain the mortgaged premises and improvements in good repair, the Mortgagee may do

Mortgage Indenture.
(6) The Mortgagors shall not transfer title to the abo"'e described property or any part
thereof without tho prior written consent of the Mortgagee. * Such a transfer by the
Mortgagors shall constitute a default under the terms of the Mortgage Note and this
Mortgage Indenture and the entire balance and outstanding interest and penalties, if any,
owing to the Mortgagee shall immediately become due and payable.
(7) At any time after default for a period of 30 days in any payment due on the debt
or in fulfillment of any obligation under the Mortgage Note, this Mortgage Indenture, and
the agreement ref cITed to at (3) above, if any, all of the debt shall become due and payable
at the option of the Mortgagee and without notice, and foreclosure proceedings may be
brought fort..\with on this Mortgage Indenture and prosecuted to judgment, execution and
sale for the collection of the same, together with costs of suit and any attorney's comrrrigsion
of 10% for collection added.
The covenants and agreemenUi contained in this Mortgage Indenture shall bind, and
the benefits thereof shall inure to, the Mortgagors and the Mortgagee, and their heirs,
executors, adminiitrators and assigns of the Mortgagors, and if this Mortgage Indenture is
