St.Cyr, by his attorney, Nathan C Wolf, Esquire, and presents this petition for a Citation upon the respondent, Phillip H St.Cyr, representing as follows: 1. Petitioner is Jeffrey E. St.Cyr, an adult individual residing at 1915 Douglas Drive, Carlisle, Gunberland County, Pennsylvania 17013. 2. Decedent is Robert E. St.Cyr, deceased, who died intestate on January 16,2007, and who, at the time of his death, resided with Petitioner at 1915 Douglas Drive, Carlisle, Cumberland County, Pennsylvania. 3. Petitioner is one of five surviving children of the decedent. 4. Decedent left no surviving spouse. 5. Respondent is Phillip H St.Cyr, an adult individual residing at 712 15th Street, New Gunberland, Gunberland County, Pennsylvania, 17070-1511. 6. Respondent is the brother of Petitioner and also one of the surviving children of the decedent. 7. Petitioner, on October 11, 2007, filed a petition for grant of Letters of Administration with the Register of Wills of Gunberland County for the administration of the Estate of Robert E. St.Cyr, deceased. 8. Simultaneously therewith, Petitioner presented Renunciations of Bruce St.Cyr, Gregory St.Cyr, and M Pauline Shunk, requesting the grant of Letters be issued to Petitioner. 9. Petitioner has previously attempted to obtain a renunciation from Respondent, without reply whatsoever. 10. Petitioner has been forced to delay the administration of the Estate pending the grant of Letters by the Register because Respondent neither executed the renunciation nor filed his own petition for the grant of Letters of Administration. 11. Petitioner seeks the issuance of a citation to ensure that the administration of the estate can proceed without further delay, and to provide the Respondent the opportunity to either object to the grant of Letters or to present his own petition for the same. 12. Petitioner is without other recourse to proceed in the administration of the estate and stands ready to proceed with the administration upon the grant of Letters. WHEREFORE, Petitioner Jeffrey E. St.Cyr respectfully requests that the Register issue a Citation upon the respondent, Phillip H St.Cyr, directing the filing of an objection to the Petitioner for Grant of Letters of Administration within twenty days of receipt of service of the same, along with any additional relief that may be deemed appropriate and just.
