The decedent, Eugene Lawrence Keefe, died intestate on November 20, 2004. 2. Mary Anne Beattie was appointed Administratrix by the Cumberland County Register of Wills on February 23, 2005. 3. An Inheritance Tax Return was filed with the Pennsylvania Department of Revenue and was accepted as filed on September 23,2005. 4. A formal accounting was filed with this Honorable Court on May 18,2007. A copy of the Accounting is attached hereto as Exhibit "A" and is incorporated herein by reference. 5. An Order of Court was issued on June 19,2007, confirming the accounting in accordance with the proposed schedule of distribution. A copy of the Order of June 19,2007, is attached hereto as Exhibit "B" and is incorporated herein by reference. 6. The decedent was indebted to various creditors having filed claims against the Estate as follows: a. Citibank South Dakota) NA in an amount of $6,869.03 b. Citicorp Credit Service in an amount of$8,057.88; c. GMAC (General Motor Acceptance Corp) in an amount of $6,796.84. 7. After the filing of the Accounting and the Order entered hereinabove, it was learned that the decedent's mother, Emelia C. Keefe, presently residing at 114 Patricia Drive, Newark DE, personally paid for the decedent's funeral bill to Rothermel & Videon Funeral Home in an amount of$7,805.00. Ms. Keefe should be reimbursed by the estate for the decedent's funeral bill in the amount of $7,805.00. A copy of the paid invoice to Rothermel & Videon Funeral Home is attached hereto as Exhibit "C" and is incorporated herein by reference. 8. Decedent's estate has principal receipts in the amount of $7,246.43, which is insufficient to refund the amount owed to Emelia C. Keefe as repayment for the decedent's funeral bill and to also pay all of the aforementioned creditors. 9. Pursuant to the 20 Pa. C.S.A. ~3392 regarding classification and order of payment, claims shall be paid in the following order: a. The costs of administration b. The family exemption c. The costs of the decedent's funeral and burial d. The cost of a grave marker e. Rents for occupancy of the decedent's residence for six months immediately prior to his death f. Claims by the Commonwealth and the political subdivisions of the Commonwealth g. All other claims. 9. The aforementioned creditors fall within the final category of "All other claims". WHEREFORE, Mary Anne Beattie, Administratrix respectfully requests that this Honorable Court issue an Amended Order for the payment of the funeral bill payable to Emelia C. Keefe, in the amount of $7,246.43 and that the funds are insufficient to pay the claims filed by the following creditors Citibank, Citicorp Credit Service and GMAC.
