MECHANICS' LIEN CLAIM
AND NOW, this 19TH day of October, 2007, comes Mr. Sandman, Inc. by it's
attorney, Robert G. Radebach, pursuant to the provisions of the Act of August 24,
1963, P.L. 1175 No. 497, Article V Section 503 et seq., as amended and makes the
following statement of Mechanics' Lien Claim:
1. Plaintiff is Mr. Sandman, Inc., with its offices at 515 South 32"d Street
Annex, Camp Hill, Pennsylvania, and is the Contractor in this case.
2. The Owners of the premises in question are Kimber Shearer and Judy
Shopp, who are adult individuals residing at 2800 Fairview Road, Camp Hill,
Pennsylvania 17011, as more fully set forth in a deed recorded in Cumberland
County Deed Book 278, Page 436.
3. Mr. Sandman, Inc. avers that on or about May 2, 2007, the Contractor
commenced work on a residential establishment owned by the Defendants for the
express purpose of renovations to hard wood floor located at 2800 Fairview Road,
Camp Hill, Pennsylvania, pursuant to an a written Agreement with Judy Shopp who
represented that she was the owner of the subject premises. A copy of the
Agreement is attached hereto as Exhibit "A", which is hereby made a part hereof.
4. Work was completed on or about July 7, 2007, WHEN AN INVOICE FOR
SAID WORK WAS rendered to Defendant Shopp, a copy of which is attached
hereto as Exhibit "B".
5. The amount claimed to be due is $4566.47.
6. The premises against which this lien is claimed are as follows:
ALL THAT CERTAIN tract or parcel of land and premises, situate, lying and
being in the Borough of Camp Hill in the County of Cumberland and
Commonwealth of Pennsylvania, more particularly described as follows:
BEGINNING at a. point on the northerly line of Fairview Road which point is 172.02
feet East of the northwesterly comer of Conodoguinet Drive and Fairview Road and
at dividing line between Lots Nos. 12 and 13 on the hereinafter mentioned Plan of
Lots;
thence by said dividing line, North 52 degrees 18 minutes East, 332 feet to a point
on the westerly line of edge of water of Conodoguinet Creek;
thence along same South 50 degrees 51 minutes 40 seconds East, 168.38 feet to a
point;
thence South 61 degrees 13 minutes West, 268 feet partly by northern line of
Fairview Road to a point;
thence further along northern line of Fairview Road, on an arc having a radius of
100 feet in a northwesterly direction to the right, 98.23 feet to a point;
thence further along same, North 62 degrees 30 minutes West, 72.23 feet to a
point, the place of BEGINNING.
BEING Lot No. 13 in Plan of Country Club Hills which Plan is recorded in.
Cumberland County Recorder of Deeds Office in Plan Book 9, Page 33, and an
additional tract of land between said Lot and the edge of the center of
Conodoguinet Creek.
UNDER AND SUBJECT, nevertheless, to easements, restrictions,
reservations, conditions and rights of way of record or visible upon inspection of
premises.
BEING the same premises which John C. Shirvin y and arol P,
Shirvinsky, husband and wife, by deed dated Decemb r 15, 20 , and recorded in
Cumberland County Deed Book 278, Page 436, gra and nv ed nto Kimber
Shearer and Judy Shopp.

6. The charges for additional work performed at the express request of
Defendant Shopp are the customary charges made by Plaintiff for
are prevailing charges in the vicinity of the subject premises
