THIS AGREEMENT made the ~ day of October, 2007, by and between Yingst Homes,
Inc., a Pennsylvania corporation, hereinafter referred to as Contractor, and Vanessa H. Green and
Margaret E. Chester, hereinafter, collectively, referred to as Owner, whereby the former undertook
and agreed to erect and construct a custom built home for Owner on that certain lot of ground situate
in Hampden Township, Cumberland County, Pennsylvania, at Lot 26, Grand Meadows, a Planned
Community, as shown on Declaration Plats and Plans recorded in the Office of the Recorder of
Deeds of Cumberland County, Pennsylvania, in Miscellaneous Book 734, Page 953, more fully
described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish the
right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN Unit, being Unit No. 26 (the "Unit"), of Grand Meadows, A
Planned Community (the "Community"), such Community being located in Hampden Township,
Cumberland County, Pennsylvania, which Unit is designated in the Declaration of Covenants and
Restrictions for Grand Meadows, A Planned Community (the "Declaration") and Declaration Plats
and Plans recorded as an exhibit thereto in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania, in Miscellaneous Book 734, Page 953, together with any and all amendments
thereto.
TOGETHER with the undivided Allocated Interest appurtenant to the Unit as more
particularly set forth in the aforesaid Declaration, as last amended.
TOGETHER with the right to use any Limited Common Elements appurtenant to the Unit
being conveyed herein, pursuant to the Declaration and Declarant Plats and Plans, as last amended.
UNDER AND SUBJECT to the Declaration; to any and all covenants, conditions,
restrictions, rights-of--way, easements and agreements of record in the aforesaid Office; and to
matters which a physical inspection or survey of the Unit and any Common Elements would
disclose.
BEING part of the premises granted and conveyed unto Fishing Creek Valley Associates,
L.P., a Pennsylvania limited partnership, Grantor herein, by deed from Ivan J. Miller and Tammy S.
Miller, his wife, dated Apri14, 2006, and recorded on Apri17, 2006, in Deed Book 273, Page 4551;
by deed from Dwayne Deimler a/k/a Dwayne A. Deimler and Karen A. Deimler, husband and wife,
dated March 23, 2006, and recorded on March 28, 2006, in Deed Book 273, Page 3576; by deed
from Curtis L. Stroup and Leslie A. Rahauser, husband and wife, dated March 13, 2006, and
recorded on June 9, 2006, in Deed Book 275, Page 304; and by deed from Lee Roy Sawyer and
Kathryn R. Sawyer, husband and wife, dated Apri14, 2006, and recorded on Apri17, 2006, in Deed
Book 273, Page 4554. Less and except that tract or parcel of land Fishing Creek Valley Associates,
L.P. conveyed to Ivan J. Miller and Tammy S. Miller, his wife, by Deed dated April 4, 2006, as
recorded on June 9, 2006 in Deed Book 275, page 296 in the Office of the Recorder of Deeds in and
for Cumberland County. Also, less and except that tract or parcel of land Fishing Creek Valley
Associates, L.P. conveyed to Lee Roy Sawyer and Kathryn A. Sawyer, husband and wife, by Deed
dated Apri14, 2006, as recorded on June 9, 2006 in Deed Book 275, Page 300 in the Office of the
Recorder of Deeds in and for Cumberland County.
