Wolanin-Saifi of 3503 Countryside Lane, Camp Hill, PA 17011, is about to execute contemporaneously herewith, a contract, with Home Designs Unlimited LLC of New Kingston, PA, for the erection of a building upon premises commonly known as 1111 Saffron Drive, Township Hampden, Cumberland County, Pennsylvania, as set forth in the deed dated 07/14/05, recorded at Deed Book 270, Page 316, in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, October 25, 2007, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Wolanin-Sai .-~' _~ EXHIBIT "A" ALL THAT CERTAIN tract or lot of land, situate in Hampden Township, Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and described as follows to wit: BEGINNING at a point on the southern dedicated right-of-way line of Saffron Drive at the dividing line of Lot #459 of The Highlands of Hampden Square Phase I (recorded in Plan Book 53, Page 112) and subject premises; Said point also being located 130.00 feet West of the northern extremity of an arc connecting the southern dedicated right-of-way line of Saffron Drive (50 feet wide) and the western dedicated right-of-way line of Tiverton Road (50 feet wide); THENCE by line of Lot #459 of The Highlands of Hampden Square, Phase I South 38 degrees 25 minutes 22 seconds West 115.63 feet to a point; Thence by line of Lot #960 of The Highlands of Hampden Square Phase III {recorded in Plan Book 59, Page 137) North 75 degrees 32 minutes 05 seconds West 87.03 feet to a point; Thence by line of Lot #457 North 14 degrees 27 minutes 55 seconds East 120.00 feet to a Thence by the southern dedicated right-of-way line of SaffronpDrive South 75 degrees 32 minutes 05 seconds East 70.00 feet to a point; Thence by same by a curve to the right having a radius of 150.00 feet and an arc length of 66.10 feet to a point, the place of beginning. BEING Lot #458 as shown on the Final Subdivision Plan of The Highlands of Hampden Square, Phase V, recorded in Plan Book 69, Page 113.
