W~gREAS, Scott R. Gates, of Cumberland County,
Pennsylvania, is about to execute contemporaneously herewith,
a contract with D & E CONSTRUCTION, of Cumberland County,
Pennsylvania, for the erection of a one and one-half (1 1/2)
story cape cod home, upon a lot of land situated at Lot No. 7,
Miller Boulevard, Tax Parcel Number 22-12-0348-244,
Mechanicsburg, Monroe Township, Cumberland County,
Pennsylvania. (See legal description attached hereto as
Exhibit "A".)
NOW, this ~ day of October, 2003, at the time of
and immediately before the execution of the principal
contract, and before any authority has been given by the said
Owners to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration
of the making of the said contract with Contractor, and the
further consideration of One and 00/100 Dollar ($1.00) to
Contractor paid by the Owner, it is agreed that no lien shall
be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.

ALL THAT CERTAIN' tract of land situate in Monroe Township, Cumberland County, Pennsylvania,
being identified as Lot No. 7 as shown on a plan of lots known as "Final Subdivision Plan for
BREECHES BEND" Prepared by Hoover Engineering Services, Inc., dated September 23, 1997,
approved February 26, 1998, and recorded March 11, 1998 in the office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania in Plan Book "76" on page 60, and being more fully described as
follows to wit:
BEGIN'X'ING at a point on the Center Line of Miller Boulevard (a sixty foot ultimate right-of-way) (T-
621), at a common p:'operty comer of Lot No. 6 and Lot No. 7 as shown on the above referenced Final
Subdivision Plan of Breeches Bend; thence from said point of beginning along said Lot No. 6 South J4
degrees 40 minutes 59 seconds East, a distance of four hundred thirty and-two hundredths (430.02) fe~t
to a point at Lot No. 8: thence along said Lot No. 8 South 14 degrees 59 minutes 52 seconds West,
