THIS AGREEMENT made the ~ tt~ day of 0 (.3LO ~ g'~ ,~:~2003,
by and between
S&A CUSTOM BUILT HOMES, INC.,
hereinafter referred to as Contractor,
AND
JAY S. LIVINGSTON and KAREN L. LIVINGSTON, husband and wife,
, hereinafter referred to ~
Owner, whereby the former undertook and agreed to erect and construct a single-family dwelling house
on that certain lot of ground situate in
the Township of West Pennsboro, Cumberland County, :Pennsylvania, known as Lot
53 on subdiv±s±on plan known as "Greystone Acres, ?base 2" as recorded in the
Off±ce of the Recorder of Deeds ±n and for Cumberland County, Pennsylvania, ±fi
Plan Book 72, Page 70, and as more fully described in Deed from A~bert C. and Ed±th
B. Kuhn to Owners dated October 29, 2002, and recorded in the Recorder's Off±eel
aforesa±d ±n Deed Book 254, Page 1364, all of which is/are incorporated herein
reference thereto;
NOW THEREFORe, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of
the sum of($1.00) Dollar to it, the Contractor, in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buiblings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, cz abogt the erection and construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, had maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.
