COMPLAINT
AND NOW, comes Plaintiff, Dickinson College, by and through its attorneys, MARTSON
DEARDORFF WILLIAMS OTTO GILROY & FALLER, and hereby avers as follows:
1. Plaintiff Dickinson College (hereinafter "Dickinson") is a Pennsylvania educational
institution with its principal offices located in Carlisle, Cumberland County, Pennsylvania.
2. Defendant, Kathryn Walck, (hereinafter "Student") is an adult individual whose last
known address is 12 Woodbyne Building, Middletown, Dauphin County, Pennsylvania 17057.
COUNTI
BREACH OF CONTRACT
3. Paragraphs 1 through 2 are incorporated herein by reference as if set forth in full
below.
4. Student is currently or was recently enrolled at Dickinson.
5. Student opened a Student Receivables Account (hereinafter "Account") with
Dickinson to pay tuition, dining service fees and other educational expenses provided and rendered
to Student by Dickinson. A true and correct copy of that Account is incorporated by reference and
attached as Exhibit "A."
6. Student, by opening the Account and using the goods and services provided by
Dickinson, agreed to pay Dickinson for all charges made to the Account.
7. Student received and accepted all goods and services provided by Dickinson and
thereby agreed to payment for said goods and services.
8. The terms of repayment required Student to pay all balances 14 (fourteen) days before
the beginning of each semester.
9. Student defaulted on the repayment of the Account by not paying the balance when
due.
10. Notices were forwarded to Student informing him ofhis default and right to cure such
default.
11. Student failed to cure such defaults.
12. The total amount which is immediately due and payable to Dickinson by Student on
the Account is Eleven Thousand Seven Hundred Fifty-eight and 30/100 ($11,758.30).
WHEREFORE, Plaintiff Dickinson College demands judgment against Defendant, Kathryn
Walck, in the sum of Eleven Thousand Seven Hundred Fifty-eight and 30/100 ($11,758.30), plus
late fees, costs of suit and interest from date of judgment.
COUNT II
IN QUANTUM MERUIT
In the alternative, if this Honorable Court should determine that an express contract between
Dickinson and Kathryn Walck does not exist, which is denied, Dickinson pleads the following:
13. Paragraphs 1 through 12 are incorporated herein by reference as if set forth in full.
14. Because Dickinson loaned money to Student, to the benefit of Student, Student
became liable to Dickinson for said money.
15. Student was unjustly enriched by accepting said money without paying Dickinson
reasonable compensation therefor.
16. The total amount by which Student has become enriched is Eleven Thousand Seven
Hundred Fifty-eight and 30/100 ($11,758.30).
17. Dickinson demanded payment of the above sums but Student failed and refused to
do so.
WHEREFORE, Plaintiff Dickinson College demands judgment against Defendant Kathryn
Walck in the sum ofEleven Thousand Seven Hundred Fifty-eight and 30/100, until Kathryn Walck's
obligation is paid in full, plus late fees, costs of suit and interest from date of judgment.

Defendant, Kathryn Walck, by and through her attorneys, Scaringi & Scaringi,
P.C., respectfully answers as follows:

COUNT I - BREACH OF CONTRACT
3. The answers to Paragraphs 1 through 2 are incorporated herein by reference as
if fully set forth in their entirety.

5. Admitted in part, denied in part. It is admitted that Defendant had opened on
her behalf a Student Receivables Account. It is denied that said Account
covered dining service fees. It is further denied that the copy attached to
Plaintiff's Complaint and marked as Exhibit "A" is true and correct.

8. After reasonable investigation, Defendant is without knowledge or
information sufficient to for a belief as to the truth of the averment; therefore,
said averment is denied and strict proof thereof is demanded at time of trial if
relevant.
9. Denied. It is denied that Defendant defaulted on the repayment of the
Account by not paying the balance when due.
10. Denied. It is denied that notices were forwarded to Defendant informing her
of any default and right to cure such default. It is further denied that
Defendant is in default.
11. Denied. It is denied that Defendant failed to cure defaults. It is further denied
that Defendant is in default.
12. Denied. It is denied that the amount of $11,758.30 is immediately due and
owing on the Account to Plaintiff by Defendant.
WHEREFORE, Defendant demands judgment in her favor and against Plaintiff.
COUNT II - IN QUANTUM MERIT
13. The answers to Paragraphs 1 through 12 are incorporated herein by reference
as if fully set forth in their entirety.
14. Denied. It is denied that Plaintiff loaned money to Defendant to the benefit of
Defendant. It is further denied that Defendant is liable to Plaintiff for any
money.
15. Denied. It is denied that Defendant is unjustly enriched and that Defendant
accepted money without paying Plaintiff reasonable compensation therefor.
16. Denied. It is denied that Defendant has become enriched and that the amount
thereof is $11,758.30.
17. Denied. It is denied that Plaintiff demanded payment from Defendant. It is
further denied that Defendant owes any payment to Plaintiff.

2. Defendant is Kathryn who resides at 12 Woodbyne Road, Middletown, Dauphin
County, Pennsylvania.
3. On or about July 15, 2008, Movant filed a Motion for Leave to Withdraw as Counsel
for Defendant and Rule to Show Cause in the above-captioned matter.
4. On or about August 8, 2008, Movant filed an Amended Motion for Leave to
Withdraw as Counsel for Defendant.
5. On or about August 11, 2008, the Honorable Edgar B. Bayley, Judge signed Rule to
Show Cause ordering Respondent to file an answer to the Motion for Leave to
Withdraw. (A true and correct copy of said letter is incorporated herein by reference,
made a part hereto, attached and marked as Exhibit A.)
6. On or about August 14, 2008, Movant contacted Christopher Rice, Esquire by
telephone.
7. Attorney Rice does not concur with this request.
8. On or about August 14, 2008, Movant attempted to contact William A. Duncan,
Esquire, via telephone.
9. Movant was unable to speak with Attorney Duncan.
WHEREFORE, Attorney Frank C. Sluzis prays for Your Honorable Court to grant
