WHEREAS, E. Christine Patton and Virginia L. Fessler of 6228 Stephens Crossing,
Mechanicsburg, PA 17050, is about to execute contemporaneou$ly herewith, a contract,
with Artistech, Inc. of 1087 Country Club Road, Camp Hill, PA, for the erection of a building
upon premises commonly known as 1265 Summit Way, Township Hampden, Cumberland
County, Pennsylvania, as set forth in the deed dated 07/09/03, recorded at Deed Book 258,
Page 224 (part of), in the Recorder's Office for Cumberland County., Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, October 30, 2007, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

EXHIBIT "A"
ALL THAT CERTAIN Unit, being Unit No. 88 (the "Unit"), of Hampden Summit,
A Planned Community (the "Community"), such Community being located in Hampden Township,
Cumberland County, Pennsylvania, which Unit is designated in the Declaration of Covenants and
Restrictions for Hampden Summit, A Planned Community and Declaration Plats, as amended
(collectively the "Declaration"), together with any and all improvements thereto, as more particularly
bound and described as follows, to wit;
BEGINI~TING at a point along the southern right-of--way line of Summit Way, said point being
the northeast corner of Lot 88, as shown on the "Final Subdivision Plan for Hampden Summit -Phase
2" ; thence along said right-of--way line South 14 degrees 45 minutes 20 seconds East a distance of
34.99 feet to a point; thence along said right-of--way line on a curve to the left having a radius of
- 250.00 feet, an arc length of 73.72 feet and a chord bearing of South 23 degrees 12 minutes 11
seconds East a distance of 73.45 feet to a point; thence South 58 degrees 20 minutes 58 seconds West
a distance of 133.40 feet to a point; thence North 20 degrees 45 minutes 57 seconds West a distance of
147.23 feet to a point; thence North 75 degrees 14 minutes 40 seconds East a distance of 132.27 feet
to a point and the place of BEGINNING.
ALSO BEING, Lot 88, Plan of Hampden Summit, Phase II, recorded in Plan Book 89, Page
83
BEING part of the same premises that Ray M. Souder a/k/a Ray M. Souder, Sr., and Fay E.
Souder by Deed dated July 9, 2003, and recorded July 10, 2003, in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Record Book 258, Page 224, granted and
conveyed unto F.A.S.T. Partners, L.P., a Pennsylvania Limited Partnership, the Grantor herein.
