OLSON, Owiler JW MUMPER CONSTRUCTION, INC., Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA WHEREAS, DANIEL C. OLSON and MELISSA S. OLSON of 133 West Locust Street, Apt. 220, Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with JW Mumper Construction, Inc, of 840 Sawgrass Lane, Mechanicsburg, Pennsylvania, for the erection of a building upon premises commonly known as 1539 FOX HOLLOW CIRCLE, LOT 19, Township LOWER ALLEN, CUMBERLAND County, Pennsylvania, as set forth in, the deed dated P~u~clml recorded at Deed Book , Page , in the Recorder s Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, September 3, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor m commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. OLSON EXHIBIT "A" ALL THAT CERTAIN piece, parcel or lot of land situate on the Eastern side of Fox Hollow Circle in Lower Allen Township, Cumberland County, Pennsylvania, and being more fully bounded and described as follows: BEGINNING at a point on the Eastern right of way line of Fox Hollow Circle at the Southwest corner of Lot No. 18; thence along said Lot North 78 degrees 27 minutes 23 seconds East, a distance Of 353.03 feet to a point on dine of lands now or formedy of Richard P. and Joan M. Eldredge; thence along said lands, South 09 degrees 30 minutes 00 seconds East, a distance of '~02126 feet to a point at the Northeast corner of Lot No. 20; thence along said Lot South 79 degrees 47 minutes 26 seconds West, a distance of 347.27 feet to a point on the Eastern right of way line of Fox Hollow Circle; thence along said line the following two (2) courses: 1) North 03 degrees 25 minutes O0 seconds West, a distance of 21.29 feet to a point; 2) By a line curving to the left and having a radius of 175.00 feet, an arc length of 73.71 feet, and a chord bearing of North 15 degrees 29 minutes 07 seconds West, a distance of 73.17 feet to a point, the Place of BEGINNING. CONTAINING 0.78 acres and being Lot No. 19 of High Meadow; Phase II. BEING known as Lot No. 19, as shown on the revised Plan of Lots Nos. 17, 18, 19 and 20, of High Meadow, Phase II, as recorded in the Office of the Recorder of Deeds in and for Cumberland County, in Plan Book 57, Page 148. UNDER AND SUBJECT to Declaration of Protective Covenants, as recorded on March 20, 1979, in the Office of the Recorder of Deeds in and for Cumberland County, in Miscellaneous Book 242, Page 215.
