AND NOW, comes the Cumberland County Board of Assessment Appeals, and County
of Cumberland, Pennsylvania, by Stephen D. Tiley, Esquire, Assistant Cumberland County
Solicitor for Tax Matters, and files this Answer of which the following is a statement:

3. Admitted in part. Denied in part. The averments of this paragraph are admitted
except that the last record title owner of the property known as Parcel No. 10-20-1840-013 is
Overnite Transportation Company of P.O. Box 1216, Richmond, Virginia 23218. The County
has been told that UPS Ground Freight, Inc., purchased Overnight Transportation Company but
has no independent knowledge thereof, does not know if Overnite Transportation Company
remains an independent operating subsidiary, and there has been no deed transfer. Strict proof at
trial is demanded.

5. Admitted in part. Denied in part. The averments of this paragraph are admitted
as stated. The prior assessment of $7,920,000 was for Parcel 10-20-1840-013, the tax parcel
referenced in this appeal. Overnite Transportation Company also owned Parcel No. 10-20-1840-
021, carrying an assessment of $180,000. That parcel was also appealed to the Board of
Assessment Appeals. At the Board Hearing, the taxpayer agreed to the consolidation of Parcel
10-20-1840-021 into Parcel No. 10-20-1840-013. Therefore, the pre-existing assessment for the
purposes of the within appeal to Court is $8,100, 000.

7. Admitted in part. Denied in part. The averments of this paragraph are admitted
as stated. However, due to the parcel consolidation discussed at paragraph 5 of this Answer, the
pre-existing assessment of $180,000 for Parcel No. 10-20-1840-021, was reduced to zero since
the value of that property is now reflected in the value of Parcel No. 10-20-1840-013. The pre-
existing assessment which is the subject of this appeal is, therefore, $8,100,000.
8. Denied. The averments of this paragraph, and each of its sub-lettered paragraphs,
set forth conclusions of law to which no responsive pleading is required.
WHEREFORE, Respondent, Cumberland County Board of Assessment Appeals, and
County of Cumberland, pray Your Honorable Court for an Order denying the Petitioner's appeal
or fixing the property at such value as to Court may determine to be just and proper.
