Fritz : Defendants CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE And now comes Washington Mutual Bank, by its attorneys, Zucker, Goldberg & Ackerman, LLC, and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff, Washington Mutual Bank, which has its principal place of business at 7255 Baymeadows Way, Jacksonville, FL 32256. 2. The Defendants, Eric G. Fritz and Maureen A. Fritz, are individuals whose last known address is 212 East Simpson Street, Mechanicsburg, PA 17055. 3. On or about November 22, 1999, Eric G. Fritz and Maureen A. Fritz executed a Note in favor of North American Mortgage Co. in the original principal amount of $95,500.00. 4. On or about November 22, 1999, as security for payment of the aforesaid Note, Eric G. Fritz and Maureen A. Fritz made, executed and delivered to North American Mortgage Co. a Mortgage in the original principal amount of $95,500.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on November 23, 1999, in Mortgage Book Volume 1583, Page Zucker, Goldberg & Ackerman, LLC FRP-93479 548. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part hereof. 5. The aforesaid Note and Mortgage was assigned by Washington Mutual Bank is f\k\a North American Mortgage Co. to, plaintiff herein, pursuant to an assignment of mortgage to be recorded. 6. Defendants are record and real owners of the aforesaid mortgaged premises. 7. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. 8. On or about September 18, 2007, Defendant(s) were mailed a combined Notice of Homeowners' Emergency Mortgage Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983 and Act 6 of 1974, 41 P. The amount due and owing Plaintiff by Defendants is as follows: Principal $ 88,127.18 Interest through 10/23/2007 $ 3,846.74 Attorneys' Fees $ 1,250.00 Title Search & Costs $ 2,500.00 Late Charges $ 75.14 Suspense Balance $ -37.57 Escrow $ 441.87 Miscellaneous $ 8.90 Pro Rata MIP/PMI $ 37.03 Total Fees $ 57.00 Total $ 96,306.29 plus interest on the principal sum ($88,127.18) from October 23, 2007, at the rate of $21.13 per diem, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of $96,306.29, with interest thereon at the rate of $21.13 per diem from October 23, 2007, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.
