For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse
is three (3) percent [72 P.S. g9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
[72 PS. 39116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 PS. 39116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent, except as noted in
72 PS. 39116(1.2) [72 P.S. 39116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 PS. 39116(a)(1.3)]. A sibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

I, JANE C. McDEill10TT, or the Township or Silver Spring,
County or Cumberland and State or Pennsylv~1ia, being or sound
and disposing mind, memory and understanding, do make, publish and
declare this my Last Will and Testament, hereby revoking and making
void any and all prior Wills by me at any time heretorore made.
1.
I direct the payment or all my just debts and runeral
expenses as soon arter my decease as the same can be conveniently
done.
2.
I give, devise and bequeath all the rest, residue and
remainder or my estate, real, personal and mixed, w~~$oeveli
and wheresoever the same may be situate, to my husbana~~JAMES
E. McDERMOTT, absolutely and unconditionally.
3.
In the event that my husba~d, JAMES E. McDERMOTT, should
predecease me, or should he die within thirty (30) days from
the date or my death, then in such event, I give, devise and
bequeath my entire estate, of whatsoever nature and wheresoever

the same may be situate, to my three (3) children, to wit,
PEGGY A. HcDERllOTT, EDHARD A. HcDERMOTT and DANIEL J. 11cDERMOTT,
share and share alike, per stirpes.

For the purpose of facilitating the settlement and
distribution of my estate, I authorize and empower my Executors
hereinafter nanIed, to sell any and all real estate which I may
own at the time of my decease, at either public or private sale
or sales.
LASTLY, I nominate, constitute and appoint my husband, JAMES
E. McDERMOTT, Executor of this my Last Will and Testament, and in
the event that my said husband should predecease me, or should
he" be unable or ill1willing to serve in such capacity for any
reason, then in such event, I nominate, constitute and appoint
my two (2) sons, EDWARD A. McDERMOTT and DANIEL J. McDERMOTT,
Co-Executors of this my Last Will and Testament, in his place
and stead, and in all instances, I direct that my said personal
representatives be excused from posting bond or other secUl~ity
for the faithful performance of their duties in any jurisdiction.

I wish my childhood books kept in the family and given to whoever wants them
and will take care of them.
The rest of my books I want distributed to whoever wants them or sold and
donated. Take great care not to get rid of anything of value.
Some of the books in the middle bedroom are old and may have some worth.
They came down from my family. Feel free to sell them if you wish or each of you
may choose what you want.
My costume jewelry goes to whoever wants it. There is considerable that dates to
my youth. I want everyone to take back whatever jewelry they have given me.
The blue pearl necklace, earrings and ring, which was purchased through the
Overseas Exchange catalog via Daniel for Jim to give to me-sell or give to
whoever wants it.
The Elna sewing machine and accessories to it, sell or give to whoever wants
them.
My sewing supplies, materials, etc. are to be given in entirety or parceled out to
whoever wants them. There is considerable on closet shelves and basement
bureau.
The handmade child's crib, which I believe was made by my great great
grandfather, last name Walter, stays in the family, a toss to whoever wants it.
This used to have rockers on it. Grandma Dee said she rocked my grandmother,
Ida, her sister, in it and one time it went down the cellar stairs.

I am distressed that there does not seem to be an equal distribution of my effects
to Edward and Daniel. I wish you both to take whatever else interests you. I also
wish that there be no ill feelings between Peggy, Edward and Daniel as to who is
given whatever. Perhaps you can make equitable distributions between
yourselves if I have given unwisely.
I also make the request that whatever is passed on to the three of you, that you
make every effort to assure these things stay in the family.
